Pursuant to subdivision 5 of Section 23-1101 of the Environmental Conservation Law, the New York State Department of Environmental Conservation hereby gives public notice of the following:
The Department has determined that public bids for the leasing of parcels of State land totaling 33.61 acres of State Route 13 in the Town of Veteran , Chemung County for oil and natural gas production is unreasonable and impracticable.
The Department intends to lease such lands to Fortuna Energy, Inc. for such purpose.

Monroe County - The Penfield Town Board, as lead agency, has determined that the proposed 2940 Atlantic Avenue Rezoning Application will not have a significant adverse environmental impact. The action involves an application for rezoning of 25.4 acres of land from RR-1 (single family minimum 1 acre lot) to R-1-20 (single family minimum 20,000 sq. ft. lot). The project is located at 2940 Atlantic Avenue.

Steuben County - The Steuben County Industrial Development Agency, as lead agency, has accepted a Draft Environmental Impact Statement on the proposed Howard Wind Power Project. A public hearing will be held on April 4, 2007, at 6:00 p.m. to 9:00 p.m. at the Town of Howard Fire Hall, 3622 County Road 70A, Avoca , New York. Public comment period ends May 2, 2007. The action involves the construction of 25 wind turbine units for the purpose of generating approximately 62 MW’s of electricity. The turbines would be located in the Town of Howard, Steuben County, New York.

Monroe/Wayne Counties - The New York State Department of Environmental Conservation (Department), as State Environmental Quality Review Act (SEQR) Lead Agency, has accepted a Final Supplemental Environmental Impact Statement (FSEIS) on the proposed Parkway Expansion Phase III and Vertical Expansion. The proposed Parkway Expansion Phase III and Vertical Expansion is a lateral and vertical expansion of the existing, permitted Western Expansion Landfill (WEX) and Parkway Expansion Phase I and II landfills. The proposed expansion includes a vertical expansion over a 7.4 acre overliner over the northeast corner of the closed landfill and approximately 90 acres over the existing, permitted landfill. The vertical expansion is anticipated to be approximately 100 feet above the existing, permitted landfill. The proposed lateral expansion includes 144.3 acres of "new" landfill operations in the Town of Macedon (138.5 acres) and Town of Perinton (5.8 acres) with an additional 33 acres of undeveloped land utilized for support operations (i.e., roadways, berms, sedimentation basins). This proposed expansion will extend the life of the landfill an additional 43.3 years. The expansion will not involve any changes in the operations of the facility or the approved design capacity. A double composite liner system and primary and secondary leachate collection systems will be utilized in the design of the landfill expansion. This project also involves mitigation for fill of approximately 9.3 acres of federally regulated wetland. Mitigation will include creation of additional wetland areas adjacent to NYS FWW MA-12 and enhancements of NYS FWW MA-12 to promote habitat diversity.

Project Location: 425 Perinton Parkway - The proposed landfill expansion area is bounded on the south by the NYS Barge Canal, the east by Wayneport Road and north by Budlong Road, and on the west by the existing landfill. The facility is located in the Towns of Perinton and Macedon, Monroe and Wayne Counties.
