The Department of Environmental
Conservation (DEC) has received an application to
renew State Pollutant Discharge Elimination System (SPDES) # NY 010 2806, for
Tuxedo Heights Condominiums in the town of Southfields. This is a pre-existing
Private/Commercial/Institutional SPDES permit. DEC has made a tentative
determination to renew this permit and set a standard five year term maintaining current
effluent limitations and monitoring and reporting requirements. This permit involves the
surface discharge of up to 18,900 gallons per day of treated sanitary waste into Ramapo
River, a class C(T) water.

The applicant proposes to
construction portions of an outdoor, recreational complex
within State-designated Freshwater Wetland J-3 (Class II) and its 100-foot adjacent area.
The project site is located on the southeast side of Oakland Avenue, south of the
intersection with Osborn Road. The project involves the re-development of a brownfield
remediation site by constructing one baseball field, one mult-purpose athletic field, and
associated parking. The project will involve the filling and grading within approximately
0.39 acre of the wetland and 1.7 acres of the wetland 100-foot adjacent area. To mitigate
wetland impacts, the applicant has already undertaken a brownfield remediation project
on the site and provided 1 acre of enhanced 100-foot adjacent area. Further maintenance
of the remaining wetland and adjacent area will also be undertaken to manage invasive
Phragmites australis and other invasive plants. This will be accomplished by the proposed
treatment of identified areas of infestation, which will not to exceed 9 acres, with the
herbicide glyphosate and replanting with native species as needed.
