The New York State Department of Environmental Conservation (NYSDEC) administers the Brownfield Cleanup Program (BCP) pursuant to State Environmental Conservation Law (ECL) 27-1400 et seq. The BCP was created to encourage the remediation and redevelopment of contaminated properties known as brownfields. The requestor indicated above has submitted a BCP application for investigation of the site indicated above.

NYSDEC will accept public comments concerning the application. A copy of the application and other appropriate documents (application package) is available in the site document repository located at the address indicated below.

NYSDEC will review the application package and public comments received and then make a determination on the eligibility of the application.

Negative Declaration

Genesee County - The Town of LeRoy, as lead agency, has determined that the proposed Town of LeRoy Extension No. 3 to the Consolidated Water District will not have a significant adverse environmental impact. The action involves the extension of public water along a portion of Asbury Road between the Town of LeRoy Highway Garage and Mud Creek. Residents in this area are dependent upon individual groundwater supplies that historically have produced very low yields of poor quality water. Activities include the installation of watermain, fire hydrants, valves, connections, excavation and bedding materials and surface restoration. Approximately 4,200 linear feet of 8-inch watermain will be installed. The project is located in a portion of Asbury Road, Town of LeRoy.

Seneca County - The South Seneca Central School District, as lead agency, has determined that the proposed additions, alterations, renovations and site improvements to Ovid Middle/High School; new Bus Garage will not have a significant adverse environmental impact. The action involves additions, alterations, renovations and site improvements to South Seneca Middle/High School including the following work:

Steuben County - The Arkport Central School District, as lead agency, has determined that the proposed New Bus Garage and Shared Transportation Services Facility will not have a significant adverse environmental impact. The action involves construction of a new bus garage and shared transportation services facility including acquisition of land and site development for parking, driveways and utilities. The project is located south of NYS Route 961F, west of County Route 67 (Bishop Street), east of Canisteo River, north of the Bates and Hess Properties in the Village of Arkport.
