The Department has
received a Title V (Air) renewal application from the New York State
Office of General Services located at the Empire State Plaza, Albany, NY. for the continued
operation of the Sheridan Avenue Steam Plant facility located at Sheridan Avenue, Albany, NY.
The facility is a boiler plant with seven (7) boilers that serve the Empire State Plaza and nearby
buildings.
Persons wishing to
inspect the subject Title V files, including the application with all relevant
supporting materials, the draft permit, and all other materials available to the DEC (the
"permitting authority") that are relevant to this permitting decision should contact the DEC
representative below. It is recommended that an appointment be made to confirm the availability
of the subject files. The DEC will endeavor to make the files available within two (2) business
days of contact, during normal business hours (8:30 a.m. through 4:45 p.m.), unless the requestor
wishes to inspect the files at a later date.
DEC will evaluate
the application and the comments received on it to determine whether to hold
a public hearing. A public hearing may be legislative or adjudicatory. A legislative public
hearing is a proceeding which provides an additional opportunity for public comment. DEC’s
determination to hold a legislative public hearing will be based on whether a significant degree
of public interest exists. If a legislative public hearing is to be held, a Notice of Hearing
will be
published which will include the time and place of the hearing and submitting comments. The
applicant and all persons who have filed comments on the permit will be notified by mail of the
public hearing. Comments and requests for a legislative hearing should be in writing and
addressed to the Department representative listed below.
An adjudicatory public
hearing is a trial type proceeding which provides the opportunity for
adjudication on the basis of evidence, including direct testimony and cross examination. An
adjudicatory hearing is held only if substantive and significant issues relating to any findings or
determinations the Department is required to make pursuant to the Environmental Conservation
Law exist. A copy of the Department’s permit hearing procedures is available upon request
or on
the Department’s wed site at: http://www.dec.state.ny.us/website/ohms/gudph1.htm.
Comments will be
received for 30 days from the date of this notice. If comments are received
which raise significant issues or provide additional relevant information, the Department may
modify the draft renewal permit.

The applicant proposes to
modify its State Pollutant Discharge Elimination System
(SPDES) permit (number NY-0102962) to add washing of buses at its existing
maintenance garage at the Junior-Senior High School campus. The modification would
allow a discharge of up to 960 gallons per day of wash water, after treatment through an
oil-water separator and sand filter system, before discharging to Mosher Brook, which is
a Class C waterbody.
The department has made
a tentative determination to allow this permit modification
under Article 17 of the Environmental Conservation Law. This tentative determination
indicates that the discharge regulated under this statute is considered to satisfy regulatory
standards for permit issuance, based on information available to the Department at this
time. As a tentative determination, the Department seeks comments on the proposed
regulated activity prior to making a final decision on permit issuance. Comments will be
received for 30 days from the date of this notice. If comments are received which raise
significant issues or provide additional relevant information, the Department may modify
the draft permit, or conduct a hearing. Refer to the application number and SPDES
number listed in this notice on all correspondences to the department regarding this
application.

6531) of the NYCDEP Margaretville Waste Water Treatment Plant as part of Consent
Order R4-2005-0419-45. The proposed changes would require NYCDEP to
continuously operate and maintain the Supervisory Control and Data Acquisition
(SCADA) system at the facility and notify the Department of Environmental
Conservation (DEC) with 30 days of the implementation of any major changes (e.g.
substantial alterations to the scope or technology) of the SCADA system. The
modification would also include several other minor reporting modifications. The
Margaretville Plant has surface discharge into the East Branch Delware River, a class
A(T) water. DEC seeks comments on the proposed regulated activity prior to making a
final decision on permit issuance.
