Hammer Packaging Corporation has submitted
an application for a Title V Facility
Permit for its lithographic printing facility.
The Facility was originally issued an Air
State Facility Permit for operation of its original
five lithographic printing presses, on February 22, 1999. That Permit included
conditions to restrict emissions of volatile organic compounds (VOC) and hazardous air
pollutants (HAP) to below 6NYCRR Part 201-6 (Title V) thresholds of 50 tons per year of
VOC, 10 tons per year of any individual HAP compound, and 25 tons per year of all HAP
compounds combined. A sixth lithographic press was added in 2004, and a seventh in
2005, under the provisions of the operational flexibility plan in the Permit. These
additions did not change any emission limits or regulatory requirements established in
the Permit.
Due to expanding operations, Hammer Packaging
Corp proposes to remove the existing
limits on VOC and HAP emissions. Potential facility emissions of VOC will exceed the
major source threshold of 50 tons per year. This will make the facility subject to the
permitting requirements of Title V and the requirements of 6NYCRR Part 234, which
regulates VOC emissions from major graphic arts sources.

The Department has
prepared a Draft Permit and has made a tentative determination to approve this
application.
In accordance with
6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States
Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit
if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR
Part 201.
Persons wishing to
inspect the subject Title V files, including the application with all relevant supporting
materials, the draft permit, and all other materials available to the DEC (the "permitting authority")
that are
relevant to this permitting decision should contact the DEC representative listed below. It is
recommended
that an appointment be made to confirm the availability of the subject files. The DEC will endeavor
to
make the files available within 2 business days of contact, during normal business hours (8:30 am through
4:45 pm), unless the requestor wishes to inspect the files at a later date. The Draft Permit and
Permit
Review Report may be viewed and printed from the Department web site at:

DEC will evaluate
the application and the comments received on it to determine whether to hold a public
hearing. A public hearing may be legislative or adjudicatory. A legislative public hearing
is a proceeding
which provides an additional opportunity for public comment. DEC's determination to hold a legislative
public hearing will be based on whether a significant degree of public interest exists. If
a legislative public
hearing is to be held, a Notice of Hearing will be published which will include the time and place of
the
hearing and submitting comments. The applicant and all persons who have filed comments
on the permit
will be notified by mail of the public hearing. Comments and requests for a legislative public
hearing
should be in writing and addressed to the Department representative listed below.
An adjudicatory public
hearing is a trial type proceeding which provides the opportunity for adjudication on
the basis of evidence, including direct testimony and cross examination. An adjudicatory hearing
is held
only if substantive and significant issues relating to any findings or determinations the Department
is
required to make pursuant to the Environmental Conservation Law exist. A copy of the Department's

Frazier Industrial Company has submitted
an Air State Facility application for its
Waterloo Facility, which manufactures industrial steel storage rack systems. Facility
operations include steel part welding, cleaning, dip coating, and spray coating, and are
currently regulated by permits for individual process emission points, in effect prior to
enactment of current regulations. The Air State Facility application submitted does not
propose a change in operations, but will allow the Department to issue a single permit
for all operations at the facility.
In the current emission point based permits,
facility emissions of volatile organic
compounds (VOC) and hazardous air pollutants (HAP) are restricted to below 50 tons
per year of VOC, below 25 tons per year total HAP, and below 10 tons per year for each
individual HAP compound, by permit conditions limiting coating use. These are
applicability thresholds in 6 NYCRR Part 201-6 (Title V) regulations, and the restrictions
allow Frazier Industrial Company to remain below Major Stationery Source thresholds
requiring a Title V Permit.
As part of this application, Frazier Industrial
Company seeks to maintain its current
emissions restrictions below the Title V VOC and HAP thresholds indicated above, by
continuing to limit coating use.
In response, the Department has generated
a Draft Air State Facility Permit that allows
Frazier Industrial Company to remain capped below Title V thresholds for VOC and
HAP. To verify compliance, Frazier Industrial Company will be required to maintain
records of coating use and emissions at the facility, to be maintained on site for a
minimum of five years, and made available with all supporting data to Department
inspectors upon request.

(#3) to a production well to replace an existing well (#1) which is to be abandoned and to
take for use within the North Cohocton Water Supply system an additional supply of
