for re-issuance and transfer of a mining permit for a previously
approved sand and gravel mine for the Bert E Hale Gravel Mine. The permit allowed
mining on 31 acres during the previous permit term. The permit expired on August 31,
2006. The applicant has reclaimed 5 acres. The applicant now proposes to continue
mining within this previously permitted 26 acre portion of the mine during the next
permit term. The project is located on Gould Road, off Route 369, in the Town of
Fenton, Broome County.

The Department has prepared
a draft permit pursuant to Article 19 (Air Pollution Control)
of the NYS Environmental Conservation Law and made a tentative decision to issue an
Air State Facility Permit to AES Westover for its facility located in Johnson City, NY.
AES Westover is an electric
generating system consisting of two steam turbines and three
coalfired boilers. Through an agreement with the DEC two of the boilers (Boilers 11 and
12) will operate on restricted hours. In order to insure the availability of steam when all
three boilers are shut down, the facility is adding a new package boiler. The package
boiler will fire natural gas and has a maximum heat input capacity of 32.7 mmBtu/hr.
The boiler will be subject
to New York State?s Nitrogen Oxide Reasonably Available
Control Technology (NOx RACT) rule and the federal New Source Performance
Standard found at 40 CFR Part 60, Subpart Dc and the federal National Emission
Standards for Hazardous Air Pollutants For Industrial, Commercial and Institutional
Boilers and Process Heaters, 40 CFR Part 63, Subpart DDDDD.
