The applicant proposes an increased discharge amount from 120,000 gallons per day (GPD) to 135,000 GPD of treated municipal wastewater to Lake Champlain, a Class "A" waterbody, from a recently upgraded, secondary treatment plant which is located at 22 Champlain Ave in Westport. The draft permit has been modified to reflect the increased flow rate as well as corresponding increases in the biological oxygen demand (BOD₅) and total suspended solids (TSS) effluent loadings.

The Department has made a tentative determination to issue a permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation law.  This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time.  As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.  As such, this tentative determination does not signify department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project.  Refer to this application by application number listed above and SPDES No. NY- 020 0222.

Applicant proposes to expand an existing 9-acre sand and gravel mine by 6 acres (for a total of 15-acre Life of Mine).  The entire 15 acres will be affected during the next 5 year permit term.  Continued operations include onsite processing with portable screening equipment.  The mine is located northwest and northeast of the intersection of Woodmere Lane and Tamarack Road in the Town of Lake Pleasant.  This proposal is also under review by the Adirondack Park Agency (APA#2006-304).
