  The applicant has proposed a reduction in the number of acres to be mined from 37.5 to 29.5.  The applicant has also proposed to mine the remaining 29.5 acres to an elevation that is 20' lower than originally permitted.  The applicant's proposal is in response to discussions with Department staff and the Department's discovery of freshwater wetlands in the vicinity of the mine that were not previously identified.

The Department has made a tentative determination to approve a modification and renewal of the existing Part 360 Solid Waste Management Permit for the AES Cayuga coal ash landfill. The modification involves a 10' vertical expansion on top of the previously approved 1984 Phase II landfill section which is 7.9 acres in size. The expansion is necessary to extend the life of the landfill to accommodate coal ash produced by the AES Cayuga electric power generation facility nearby. AES Cayuga is also seeking alternative uses for the ash material. A liner system will be installed over the existing landfill before additional material is added and a geo-membrane cap system will be installed over the final grade of the entire Phase II landfill that meets current Part 360 standards. Water quality monitoring will continue as required by Part 360. The application and the draft permit are available for review in the Cortland DEC Office.
