The New York State Department
of Environmental Conservation, Division of Operations,
is applying for a Water
Quality Certificate for the replacement of the Colgate Lake Dam
to meet New York State Dam Safety criteria for spillway capacity and stability.
Temporary construction access will require the installation of a temporary stabilized
stream crossing.
The existing earthen and
concrete dam will be removed following completion of the new
dam and the spoils from it will be spread/buried on site at an upland location northwest
of the proposed emergency spillway. The project site is located on the East Kill in the
Town of Jewett, Greene County.

The Department has made
a tentative determination to issue a permit for a State Pollutant
Discharge Elimination System (SPDES) permit under Article 17 of the Environmental
Conservation Law. The proposed permit is for 1200 gpd of treated sanitary wastewater
from an existing facility, discharging to Brown Brook. The facility is Carmody West
(formerly Emmetts Restaurant, on State Route 7 & County Route 100, in the town of
Hoosick. This tentative determination indicates that the discharge regulated under this
statute is considered to satisfy regulatory standards for permit issuance, based on
information available to the Department at this time. As a tentative determination, the
Department seeks comments on the proposed regulated activity prior to making a final
decision on permit issuance. As such, this tentative determination does not signify
department approval for or endorsement of the activity for which a permit is sought or for
the overall proposed project. A draft permit is available for inspection and comment at

The applicant proposes
to construct 13 new residential townhouse structures, each three to five
units in size, for a total of 48 units, on approximately 10.8 acres of a 12.6 acre parcel.
Development will also include the installation of roadways, utilities and stormwater management
structures. As proposed, the project will cause a permanant loss of approximately 0.27 acres of
Federal wetlands and approximately 185 linear feet of stream channel disturbance. To mitigate
for wetland losses, the applicant proposes to protect approximately 1.58 acres of remaining
wetlands and 1.34 acres of adjacent upland on the site via a permanent deed restriction. The
applicant has also proposed to enhance/create approximately 0.75 acres of forested wetland on
the site. The project is located on Maple Avenue just north of the Alplaus Avenue intersection.
