The Department has made a tentative determination to approve this application for the modification of an existing SPDES permit for a discharge of treated wastewater into the Gowanus Canal (Class SD) and the Gowanus Bay (Class I) from a bulk petroleum storage facility located at 722 Court Street, Brooklyn NY 11231.

Compared to the existing permit that this modification will replace, the following significant changes are proposed:

Add Outfall 002 - New discharge outfall is a result of secondary containment system upgrades required by NYSDEC’s Petroleum Bulk Storage Program for storage tanks 9411, 9412 and 9413.  The existing containment systems are being upgraded with impermeable surfaces which will result in a point source discharge of accumulated precipitation.

Add effluent limit for settleable solids at outfall 001.  

Add effluent limit for total suspended solids at outfall 01A.  

Updated permit pages and conditions reflect current Department guidance, format and boiler plate language.

The applicant has requested a 10 year maintenance dredging permit to undertake dredging activities at the 39th Street Pier. Access to the pier will also require dredging a portion of the Bay Ridge Channel in Gowanus Bay which is adjacent to the pier. The purpose of the project is to provide water depths necessary for safe mooring and maundering of vessels. The applicant proposes to dredge approximately 90,558 cubic yards, 51,496 square feet to -33 feet below mean low water. The project site is located at the South Brooklyn Marine Terminal at 1st Avenue and 39th Street, Brooklyn.

The applicant proposes the reconstruction of portions of Linden Place, 23rd Avenue and 130th Street, College Point, Queens. In addition to repaving the project roadways, the reconstruction project will standardize the roadway width, add curbs and sidewalks, replace water mains, provide new storm sewers, new street lighting and tree planting. The drainage scheme for the Linden Place Street Reconstruction project will deliver storm water runoff from the project streets to NYSDEC regulated Class II Freshwater Wetland FL-2 (Flushing Airport).

The west bulkhead of the Bayswater Peaking Facility is located along the shore of Motts Basin in Far Rockaway, New York. The proposed work provides a new concrete facing for 227 feet of the 361 foot existing bulkhead wall, and a new steel wale and soil anchors for the northern 90 feet of the existing wall. The new concrete facing consists of poured in-place concrete  with watertight timber facing below mid-tide and shotcrete (pneumatically projected concrete) facing above mid-tide. The proposed concrete facing would be installed less than 18 inches from the existing bulkhead.The applicant proposes to mitigate for the placement of 30 cubic yards of fill in Tidal Wetlands, which will result in a loss of 0.008 acres of Schoals Mudflats/Littoral Zone, by surface debris removal and planting of a 700 square feet in an area located at the head of Mott Basin in the vicinity of Horton Avenue and Pinson Street. The project site is located at 1425 Bay 24th Street, Far Rockaway.

The applicant proposes to demolish and existing house and garage and construct one 24-Family Multiple Dwelling Family Residences. A portions of the proposed building is located within the adjacent area of NYSDEC regulated Class 1 Freshwater Wetland AR-25 (Great Swamp). The project site is located at 1225 Forest Hill Road between Rockland and Ashworth Avenues, Staten Island, Block 1965 - Lot 54.

The applicant proposes to construct two new one-family detached houses including driveways, parking, sidewalk and street improvements within the adjacent area of NYSDEC regulated Class I Freshwater Wetland AR-12 (Arbutus Lake). A 19 foot wide deed restricted area of no disturbance is proposed to be established between the developed area and the freshwater wetland. A split rail fence is proposed to be installed along the area of no disturbance. The project site is located on Louise Street, Block 6552 - Lot 35.

The applicant proposes to demolish an existing 2-story frame building and construct 4 one family semi attached houses and one 2-family detached house with swimming pool. The project site is located with the adjacent area of NYSDEC regulated Class I Freshwater Wetland NA-9 (Dongan Hills). The applicant proposes to establish a 15 foot wide vegetated deed restricted area of no-disturbance between the wetland and the developed area. The project site is located at 658 Quincy Avenue, Staten island, Block 3839 - Lots 7, 10 and 12.

The applicant proposes to relocate an existing one-family house fronting on Sheldon Avenue to Sinclair Avenue and constructing anew two-family house fronting on Sheldon Avenue. A portion of the house fronting on Sinclair Avenue is located within the adjacent area on NYSDEC regulated Class II Freshwater Wetland AR-29 (Annadale North). The project site is located at 313 Sheldon Avenue, Block 6267 - Lot 9.

The applicant proposes to construct a 17 foot by 11 foot 9 inch addition at the rear of an existing one-family two-story semi-detached house. The project site is located within the adjacent area of NYSDEC regulated Class I Freshwater Wetland NA-10 (Oakwood Beach), 387 Milton Avenue, Block 4130 - Lot 404..

The applicant has requested a permit to undertake maintenance dredging with upland disposal for a 10 year period. In the initial project the applicant proposed to dredge approximately 97,000 cubic yards of material. The proposed work also includes installation of two mooring dolphins and catwalk and reinforcement of  approximately 200 feet of bulkhead. The project site is located at 4101 Arthur Kill Road, Staten Island, New York.
