The Department has made
a tentative determination to approve this application for the
modification of an existing SPDES permit for a discharge of treated wastewater into the
Gowanus Canal (Class SD) and the Gowanus Bay (Class I) from a bulk petroleum storage
facility located at 722 Court Street, Brooklyn NY 11231.
Compared to the existing
permit that this modification will replace, the following
significant changes are proposed:
Add Outfall 002 - New discharge
outfall is a result of secondary containment system
upgrades required by NYSDEC’s Petroleum Bulk Storage Program for storage tanks
9411, 9412 and 9413. The existing containment systems are being upgraded with
impermeable surfaces which will result in a point source discharge of accumulated
precipitation.
Add effluent limit for settleable
solids at outfall 001.
Add effluent limit for total
suspended solids at outfall 01A.
Updated permit pages and
conditions reflect current Department guidance, format and
boiler plate language.

a 10 year maintenance dredging permit to undertake dredging
activities at the 39th Street Pier. Access to the pier will also require dredging a portion of
the Bay Ridge Channel in Gowanus Bay which is adjacent to the pier. The purpose of the
project is to provide water depths necessary for safe mooring and maundering of vessels.
The applicant proposes to dredge approximately 90,558 cubic yards, 51,496 square feet to
-33 feet below mean low water. The project site is located at the South Brooklyn Marine
Terminal at 1st Avenue and 39th Street, Brooklyn.

The west bulkhead of the
Bayswater Peaking Facility is located along the shore of Motts
Basin in Far Rockaway, New York. The proposed work provides a new concrete facing
for 227 feet of the 361 foot existing bulkhead wall, and a new steel wale and soil anchors
for the northern 90 feet of the existing wall. The new concrete facing consists of poured
in-place concrete with watertight timber facing below mid-tide and shotcrete
(pneumatically projected concrete) facing above mid-tide. The proposed concrete facing
would be installed less than 18 inches from the existing bulkhead.The applicant proposes
to mitigate for the placement of 30 cubic yards of fill in Tidal Wetlands, which will result
in a loss of 0.008 acres of Schoals Mudflats/Littoral Zone, by surface debris removal and
planting of a 700 square feet in an area located at the head of Mott Basin in the vicinity of
Horton Avenue and Pinson Street. The project site is located at 1425 Bay 24th Street, Far
Rockaway.
