Additional Public Information Meeting on Proposal to Amend Water Quality Regulations

On December 13, 2006, the Department issued a Public Notice in the Environmental Notice Bulletin on its proposal to amend portions of Parts 700 - 704 of Title 6 of the Official Compilation of Codes, Rules and Regulations of the State of New York (6 NYCRR). The reader is referred to the December 13 Public Notice for more detailed information about the proposal, other public information meetings, and how to comment. The purpose of this notice is to announce one additional public information meeting (below) and to highlight the fact that the proposal includes a revised marine water standard for dissolved oxygen (DO).

Notice of Public Comment Period

The Draft Enhanced Phosphorus Removal Supplement

The Department (DEC) has developed a technical document to address the design of stormwater management systems for enhanced phosphorus treatment for use in phosphorus-limited watersheds. The Enhanced Phosphorus Removal Supplement is planned to be included in the existing New York State Stormwater Management Design Manual. The draft Supplement is, by this notice, made available for public review and comments.

A Request for Proposal (RFP) for the development of this new chapter was announced through the Central New York Regional Planning & Development Board in Spring of 2005. A contract was awarded to a group of qualified consultants in the summer of 2005 including:

A Technical Advisory Group was also formed to actively participate in the development of the supplement. The team of experts for the Technical Advisory Group included representatives of:

New York State Office of Attorney General
Environmental Groups
Consulting Engineers for Municipalities and Site Developers

The Enhanced Phosphorus Removal Supplement includes a narrative discussing the methodology and sizing of stormwater management practices; a section outlining the performance criteria for acceptable practices; and section on design examples. This supplement is intended to provide design standards and specifications for design of stormwater management practices in phosphorus restricted Total Maximum Daily Load (TMDL) watersheds.

Public Comment Ė The Department is soliciting comments on the Enhanced Phosphorus Removal Supplement and the design examples from individuals or agencies involved or interested in stormwater management design standards. The comment period runs until February 21, 2007.
