The New York State Department of Environmental Conservation (NYSDEC) administers the Brownfield Cleanup Program (BCP) pursuant to State Environmental Conservation Law (ECL) 27-1400 et seq. The BCP was created to encourage the remediation and redevelopment of contaminated properties known as brownfields. The requestor indicated above has submitted a BCP application for investigation of the site indicated above.
NYSDEC will accept public comments concerning the application. A copy of the application and other appropriate documents (application package) is available in the site document repository located at the address indicated below.
Please note the application package includes the Remedial Draft Investigation Work Plan which describes the remedial activities to be conducted to investigate and determine the nature and extent of the contamination related to the site. The Final Remedial Work Plan implements the decision document for the remedy selection process for the site.
NYSDEC will review the application package and public comments received and then make a determination on the eligibility of the application.
Comments should be submitted by January 29, 2007.

Livingston County - The Town of Caledonia Planning Board, as lead agency, has determined that the proposed Caledonia Ethanol Facility may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. The action involves development of agricultural ethanol production facility where corn will be processed to generate up to 55 to 60 million gallons of denatured ethanol per year for use as fuel additive, along with distillers grain and syrup co-products for use as high-protein livestock feed supplements. The project is located in the Town of Caledonia, adjoining Commodity Resource Corporation dry feed and fertilizer facility located near the northeast corner of junction of Rochester & Southern Railroad and State Route 5.

Ontario County - The Town of Victor Planning Board, as lead agency, has accepted a Final Environmental Impact Statement on the proposed Fairways. The action involves the subdivision of approximately 180 acres into 162 town home units and a 9 hole short range golf course with a club house. Also a permanent Special Use Permit for the 9 hole short range golf course. The project is located on Gillis Road and High Street in the Town of Victor.
