ENB Region 8 Completed Applications 12/13/2006

    The Department has decided to pursue a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 003-0546, DEC Identification #: 8-1836-00012), the Village of LeRoy wastewater treatment plant, pursuant to 6 NYCRR Part 750-1.18, New York State’s Environmental Benefit Permit Strategy (EBPS).  The proposed changes would include: A compliance monitoring schedule was developed for Mercury, Copper, Phenol, & Zinc; and WQBELs of 0.01 mg/l and 0.268 mg/l were developed for Antimony and Nickel respectively, based on the result of the priority pollutant scan.  The DIM would also include several other minor reporting modifications.  The permittee discharges into the Oakta Creek, a Class C stream.  The Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.  The DIM does not signify department approval for or endorsement of the activity for which the permit is granted.

The applicant proposes the demolition of an existing home and reconstruction on the existing footprint measuring approximately 936 square feet. The structure is located within the regulated Coastal Erosion Structure Hazard area, and therefore is designed to be a moveable structure. The demolition of the existing home requires a 6 NYCRR Part 505 variance.

The applicant proposes to remove two gravel bars which have been deposited in a 110' section of a tributary to Spring Brook. Approximately 160 cubic yards of material will be removed from the stream and placed in an upland site.
