Project Description:
The Department has made a tentative determination to approve an application for an existing facility that is an on-shore fuel terminal. The 6.37-acre facility property is developed with nine fuel oil and two asphalt aboveground tanks, boiler house, two truck loading racks, three marine loading berths, dispatch office, foam house and utility building. The facility operates combustion installation consisting of two Rockmills MP-800 boilers with heat input capacity of 14.705 mmBtu/hr each, burning #6 or #2 fuel oil, and one Caterpillar Model 3412 diesel engine that powers AC generator. The generator is a backup power supply used during emergencies and, potentially, this unit is participating in the NYS Coordinated Demand Reduction Program (CDRP). The facility NOx emissions are capped at 22.5 tpy. Also, the facility has the fuel oil storage and transfer operations for #2, #4, #6, diesel fuel oil and asphalt. The application, draft permit, relevant supporting materials and regulations are available for review during normal business hours at the DEC office provided in this notice. Comments of support or objection may be made by filing a written statement by the deadline date indicated. DEC may schedule a public hearing based upon an evaluation of the nature and scope of any wirtten objections raised. Hearing notices will contain instructions on filing for party status and submitting comments.

Filed application documents, and Department draft permits where applicable, are available for inspection under the provisions of the Freedom of Information Law during normal business hours at the address of the contact person.
State Environmental Quality Review (SEQR) Determination:
Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.
SEQR Lead Agency:
NYS Department of Environmental Conservation
State Historic Preservation Act (SHPA) Determination:
A cultural resources survey has been completed. The report of the survey is on file. No archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.
Coastal Management:
This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
Opportunity for Public Comment:
Comments on this project must be submitted in writing to the Contact Person no later than Jan 12, 2007.
