The Department has prepared
two draft permits and has made tentative determinations to
approve two permit actions for the Flexo Transparent, Inc. (Flexo) printing facility. The
first action is a Department initiated modification of Flexo’s existing ASF permit to
establish a new volatile organic compounds (VOC) emission cap of less than 45 tons per
year (tpy) for emission unit 1-PRINT (DEC No. 9-1402-00574/00023). This emission
unit previously had a VOC emission cap of 15 tpy. The second action is a new ASF
permit for construction and operation of a new emission unit, 2-PRINT, a 10-color
flexographic printing press and dedicated regenerative thermal oxidation control device
(DEC No. 9-1402-00574/00025). This ASF permit imposes a VOC emission cap of less
than 50 tons per year on the new emission unit. Flexo must submit an application for a
Title V permit which will incorporate the requirements of their two ASF permits within
one year of commencement of operation of emission unit 2-PRINT. Persons wishing to
inspect the subject files, including the applications with all relevant supporting materials,
the draft permits, and all other materials available to the DEC that are relevant to these
decisions should contact the DEC representative listed below. It is recommended that an
appointment be made to confirm the availability of the subject files. A public hearing may
be held if a significant degree of public interest exists.

The Gernatt Asphalt Products
Inc., Taylor Hollow Road in the Town of Collins, includes
one batch hot mix plant and one portable asphalt drum plant. The portable asphalt drum
plant was installed after June 11, 1973 and is subject to both the the opacity standard and
the standard for particulate matter in 40 CFR Part 60 Subpart I Section 92. The batch hot
mix plant was installed prior to June 11, 1973 and is not subject to Subpart I Section 92
but is subject to the opacity limit in 6NYCRR Part 212.6(a). The permit contains
conditions which limit the facility's ability to emit carbon monoxide (CO) to less than the
major facility threshold value of 100 tons per year. Once CO is capped, all other
pollutants will be capped below Title V thresholds. The capping conditions provide
specific formulae for calculating CO emissions for each emission source. Gernatt Asphalt
Products is required to annually certify continuous compliance with the emission caps
through use of a 12-month rolling total emission rate, calculated on a monthly basis. The
application, draft permit, relevant supporting materials and regulations are available for
review duiring normal business hours at the NYS Department of Environmental
Conservation office provided in this notice. Comments of support or objection may be
made by fiiling a written statement by the deadline date indicated.

The Department has
decided to pursue a Department Initiated Modification (DIM) to the SPDES permit
(NY 000-3328) of E.I. Dupont de NeMours & Company Inc.,as part of the Environmental Benefit Permit
Strategy (EBPS). The proposed changes would: modify the current method of measuring oil and grease
effluent, require a Pollutant Minimization Program (PMP) for mercury, remove monitoring requirements
for
select parameters that have been consistently measured at levels significantly below the permit action
level
over the last four years of sampling, reduce the zinc effluent limit, add a requirement for monitoring
nickel
at select outfalls, and would include several other minor reporting modifications. The permittee’s
surface
discharges occur at the following outfall locations into the respective receiving waters: 01E
and 01W - To
Niagara River via a diversion sewer (Class: A-Special); 004, 101, 103, 104, and 106 - to Niagara
River
(Class: A-Special); SW1 - Stormwater Swale to Gill Creek (Class C). The Department seeks
comments on
the proposed regulated activity prior to making a final decision on permit issuance. The DIM does
not
signify department approval for or endorsement of the activity for which the permit is granted or for
the
overall proposed project.
