The applicant proposes the
phased development of a residential subdivision consisting of
up to 43 townhouses or a combination of townhouses and single family residences on
7.51 acres of land. The total number of residences would be reduced by two (2) for each
single family detached residence constructed. The project includes the taking of a supply
of water in amounts estimated to average 13,760 gallons per day from groundwater via
two new wells identified as Well #4 and Well #5. Well #4 is a 130 foot deep bedrock
well with a tested capacity of 63 gpm and will be used as the primary source. Well #5 is
a 165 foot deep bedrock well with a tested capacity of 19 gpm and will be used as a
backup source. Maximum daily demand is estimated to be 27,520 gallons per day. Three
existing wells will be abandoned as part of the project. Sanitary waste systems will be
connected to the South and Center Chautauqua Lake Sewer District’s sewer line, which
runs through the property parallel with the Chautauqua Lake shoreline. The development
also includes two boat docks and a dry hydrant into Chautauqua Lake. Phase 1 of the
development, formerly known as Falcon’s Landing, was previously constructed and
consists of six (6) townhouses, of which one is currently privately owned and occupied.
The development's water supply system, sewers, docks and other common facilities
would be owned and maintained by a landowner's association created for the project,
Grace Bay, LLC.

The Department has made
a tentative determination to approve this application for a new
SPDES permit, #NY 0269859, for discharge to a tributary of Clear Creek. The
wastewater, generated by a proposed iron removal system for the two existing on-site
potable water wells, would be treated by a proposed lagoon system prior to discharge.
The proposed system will serve the Collins Water District #3 facility, located on Route 39
in the Town of Collins, Erie County.
