Public Notice

Pursuant to subdivision 5 of Section 23-1101 of the Environmental Conservation Law, the New York State Department of Environmental Conservation hereby gives public notice of the following:

The Department has determined that public bids for the leasing of parcels of State land totaling 1.22 acres underlying State Route 34 in the Town of Van Etten, Chemung County, 4.34 acres of State Route 225 in the Town of Corning, Steuben County and 18.30 acres of State Route 225 in the Town of Caton, Steuben County for oil and natural gas production is unreasonable and impracticable.

The Department intends to lease such lands to Fortuna Energy, Inc. for such purpose.

The New York State Department of Environmental Conservation (NYSDEC) administers the Brownfield Cleanup Program (BCP) pursuant to State Environmental Conservation Law (ECL) 27-1400 et seq. The BCP was created to encourage the remediation and redevelopment of contaminated properties known as brownfields. The requestor indicated above has submitted a BCP application for investigation of the site indicated above.

NYSDEC will accept public comments concerning the application. A copy of the application and other appropriate documents (application package) is available in the site document repository located at the address indicated below.

NYSDEC will review the application package and public comments received and then make a determination on the eligibility of the application.

Public Hearing

Steuben County - The Town of Urbana Planning Board will hold a Public Hearing on Monday, November 6, 2006 at 7:00 p.m. in the Town Hall, 41 Lake Street, Hammondsport, NY regarding Joseph Doyen, 10494 County Route 76, Hammondsport who has applied for a Site Plan Review pursuant to Town Code Chapter 88-4 which requires the Planning Board approval prior to the issuance of applicable permits to open a restaurant with an Arcade on the property owned by Richard Yartym, located at 8448 Back Valley Road, Hammondsport, NY.

Negative Declaration

Ontario County - The Town of Geneva Planning Board, as lead agency, has determined that the proposed Geneva Community Center will not have a significant adverse environmental impact. The action involves construction of a new 21,000 square foot recreational facility for the use of the Geneva Boys and Girls Club and other users consistent with the mission of the Club. The facility shall include a gymnasium, learning center, game room, performance center, parking and athletic field . The total impacted area shall be approximately 3.3 acres. The project is located on west side of Carter Road in the Town of Geneva, Ontario County. The site is located approximately 335 feet south of the Carter Road and Angelo Street intersection.

Ontario County - The Town of Geneva Planning Board, as lead agency, has determined that the proposed Walgreens Pharmacy will not have a significant adverse environmental impact. The action involves construction to include a 14,820 square foot Walgreens Pharmacy with associated parking and landscaped areas on approximately 1.8 acres of land. The project is located on land at the southwest corner of White Springs Road and Hamilton Street, (NYS Route 5 & 20).

Orleans County - The Orleans County Legislature, as lead agency, has determined that the proposed Orleans County Nursing Home Infrastructure Improvements will not have a significant adverse environmental impact. The action involves Orleans County proposing infrastructure improvements at the County Nursing Home, located on the Orleans County Campus on NYS Route 31 in the Town of Albion. Improvements are needed to eliminate serious health and safety problems related to backups of sewage into the basement of the Nursing Home, mold in the basement crawlspace, and the lack of a sprinkler system to provide fire protection. The project includes improvements to the sanitary sewer, stormwater drainage and fire protection systems that serve the Nursing Home and nearby campus buildings. Approximately 2,600 linear feet of new sanitary sewer, water line and storm sewer pipe, and 750 linear feet of drainage swale, will be installed within the Orleans County campus and along NYS Route 31. The project is located at 14012 Route 31 West, Albion, NY 14411, Orleans County.

Wayne County - The Village of Wolcott, as lead agency, has determined that the proposed Village of Wolcott Wastewater Connection with the Red Creek Area Regional WWTF will not have a significant adverse environmental impact. The action involves the Village of Wolcott which is in the process of developing plans for the construction of a wastewater connection to the Red Creek Area Regional WWTF. The project involves the construction of 30,000 l.f. of 8-inch forcemain, two pump stations, creek crossings, instrumentation and controls, building modifications to the existing plant, flow equalization and odor control. The forcemain will be installed in portions of West Port Bay Rd., Furnace Rd., Red Creek Rd., Chapmans Corners Rd. and Ford Rd. within the Village and Town of Wolcott. The Village's existing treatment plant will be decommissioned. The project is located in portions of West Port Bay Rd., Furnace Rd., Red Creek Rd., Chapmans Corners Rd. and Ford Rd., Village and Town of Wolcott, Wayne County, NY.
