The Department has made a decision  to modifiy the above mentioned permit to require disinfection in order to achieve the goals set forth in the Hudson River Estuary Action Plan, 2005 - 2009, Goal 10; see http://www.dec.state.ny.us/website/hudson/hreagenda05.pdf .  Questions concerning the technical details of the permit can be directed to Shayne Mitchell at 518-402-8125.

The applicant proposes to develop a new +/-5.62-acre sand and gravel mine on a +/-12.4-acre contiguous parcel owned by the applicant, located on the west side of SR 9, approximately 3.5 miles south of the Village of Chestertown, on the Town of Chester / Town of Warrensburg border. Mining has been occurring on the property since the 1980s, below the NYS DEC Mined Land Reclamation Law regulatory thresholds. The mine will continue to operate as a traditional surface extraction of sand and gravel by means of mechanical excavating, standard for this type of mining operation. Anticipated annual production is 10,000 cubic yards, to be excavated on an as-needed basis for the applicant's excavating business.
