Project Description:The project consists of a five lot residential subdivision of 19.9 acres creating a 4.0 acre lot (Lot 1), a 3.3 acre lot (lot 4) and a 2.1 acre lot (Lot 5) in a Hamlet land use area outside of the recreational river area of the North Branch Saranac River, a designated recreational river pursuant to the New York State Wild, Scenic and recreational River System Act. A small portion of the proposed 4.0 acre lot is located in a Low Intensity Use land use area. The project also includes the creation of a 3.5 acre lot (Lot 2) and a 4.9 acre lot (Lot 3) located in a Hamlet and Low Intensity Use land use area. The subdivision creating the 4.9 and 3.5 acre lots is located within the "river area" of the North Branch Saranac River. A 2.1 acre portion of the project site will be conveyed to either the owner of the 4.0 acre lot or the 3.5 acre lot and merged with the accepting lot, depending upon whether the purchaser of the 4.0 acre lot exercises his right-of-first refusal to purchase the additional 2.1 acres. The 2.1 acre lot is not proposed as a separate building lot. The proposed 4.0 acre lot is developed with a circa 1998 single family dwelling and each of the four other lots will be developed with a single family dwelling served by an individual on-site wastewater treatment system and well and related development in the future. Access to the project site is over Oak Lane, an unimproved road located within a 50 feet wide right-of-way. Minor improvements to Oak Lane will be necessary for the proposed project and a new cul-de-sac will be constructed on the project site to access four of the proposed five lots. The applicant states each of the proposed five lots will have deeded and contractual access to an existing beach and boat launch on the shoreline of Loon Lake. The Agency has review jurisdiction over the lots located in Low Intensity Use within the "river area".

Negative Declaration

Hamilton County - The Town of Arietta, as lead agency, has determined that the proposed Town of Arietta Land Use Plan Amendment to the APA Land Use Plan will not have a significant adverse environmental impact. The action involves zoning density changes in eleven zones and zone boundary changes in two zones of an APA Approved Plan for the town. Density and boundary line adjustments will redistribute building rights within the town to create new opportunities for affordable housing.

Project Location: Adirondack Forest Preserve, Towns of Indian Lake, Long Lake, Arietta and Lake Pleasant and the Village of Speculator

Project Description: The action involves the adoption of a comprehensive unit management plan (ump) addressing the use of and preservation of public lands. The BRW and WMPA UMP was approved and signed by the Commissioner of the Department of Environmental Conservation on September 11, 2006. Actions in the BRW and WMPA UMP include the continuation of existing recreational uses and management programs and the maintenance of existing structures and improvements, as well as the addition of new uses, programs, structures and improvements. New recreational uses include hiking and cross-country skiing opportunities on new and relocated trails. New structures and improvements include new and relocated trails, including the relocation of the Northville-Lake Placid Trail, a new lean-to along the Northville-Lake Placid Trail, new and expanded parking areas, construction of a fish barrier dam, installation of pit privies, designation or construction of tent sites, and new barriers to prevent motor vehicle use. Management proposals include protecting natural resources and the recreational environment, and the removal of nonconforming uses.

Project Title: Amendment of Town of Tupper Lake Land Use Code to designate lands of the Adirondack Club as Planned Development District ("PDD").

Brief Project Description: The Town Board of the Town of Tupper Lake has determined that enactment of Local Law #2 of 2006, to amend the Town of Tupper Lake Land Use Code by changing the zoning designation for the lands of the Adirondack Club to PDD, is a Type II Action. The action involves rezoning of the Adirondack Club lands from Highway Residential/ Commercial, Recreational/Timber Harvesting, Residential R-1, and Residential SR1 to PDD.

The Action is subject to the Class A regional project jurisdiction of the Adirondack Park Agency ("APA") pursuant to section 809 of the NYS Executive Law.

Project Location: The Action site is located in the vicinity of NYS Route 30, Lake Simond, and Moody Pond, in the Town of Tupper Lake, Franklin County, New York.

Conditions: in the event that necessary permits for the project by the Adirondack Park Agency and the Town of Tupper Lake have not been issued within forty-eight (48) months of the date of the Local Law and conclusion of all appeals and substantial construction has not commenced within said forty-eight (48) month period, the Zoning Map amendment shall be deemed rescinded and the lands shall revert to their original zoning classifications.
