Pursuant to Title 3, Article 49 of the Environmental Conservation Law, the Department of Environmental Conservation hereby gives public notice of the following:

Notice is hereby given, pursuant to Section 49-0305 (9) of the Environmental Conservation Law, of the Department’s intent to acquire a Conservation Easement from Greater Allegany Preservation, Inc., over certain lands located in the Town of Belfast, Allegany County, New York

Negative Declaration

Erie County - The Town Of Amherst Planning Board, as lead agency, has determined that the proposed Site Plan Review - Proposed Office Building will not have a significant adverse environmental impact. The action involves Iskalo Development Corp., 5166 Main Street, Williamsville, NY, 14221 proposing a 52,000± sq. ft. office building to be located at 2402 North Forest Road. The proposed office building would be located at the southeast corner of North Forest Road and John James Audubon Parkway. The property is currently occupied by the University Inn and Conference Center; the proposed office building would utilize 2.52± acres of the property in an area that is presently undeveloped yard area for the Inn. The office building would have a 120-space surface parking lot and 53-space underground parking lot, and would borrow 24 spaces from the University Inn. The office building would utilize the existing North Forest driveway and a new driveway access proposed from John James Audubon Parkway. The project is located at 2402 North Forest Road, Amherst.

Erie County - The Town Of Amherst Zoning Board of Appeals, as lead agency, has determined that the proposed Use Variance - Non-Permitted Use in R-3 Zoning District 1200/1230 Wehrle Drive will not have a significant adverse environmental impact. The action involves a use variance to operate a commercial youth training and recreation facility in the Residential District - Three (R-3) zoning district, which is not permitted in that district. The R3 zoning district permits single family detached residences, common recreation structures or uses, minor utilities, park or open space, places of worship, public utility service structures, telecommunication facilities and bed and breakfast establishments. The current activity on the site, a picnic grove, is operating under non-conforming status. The petitioner is John M. Hannon, 190 Northledge Drive, Amherst, NY 14226. The project is located at 1200-1230 Wehrle Drive, Amherst.

Erie County - The Town Of Amherst Planning Board, as lead agency, has determined that the proposed Site Plan Review - 4-Lot Fisher Pond Phase III Subdivision will not have a significant adverse environmental impact. The action involves : The project involves a 4-lot Fisher Pond Phase III subdivision to be located at 354 South Cayuga Road in the Town of Amherst. The petitioner is Fisher Ponds, LLC, 3498 Sheridan Drive, Amherst, New York 14226.

The property is located on the east side of South Cayuga Road, immediately north of the I-90 overpass and south of the Fisher Pond Phases I and II subdivision of 25 lots, which are currently under construction. The property formerly held a single-family home which has been demolished. The petitioner proposes to develop three (3) lots for single-family homes, with the fourth lot remaining as open space for use by residents of Fisher Pond Phases I, II and III. The three new home sites will be accessed via South Cayuga Road. This project is an extension of the Fisher Pond Phases I and II subdivision, which was a Type I action due to its proximity to Ellicott Creek. The project is located at 354 South Cayuga Road, Amherst.

Positive Declaration

Chautauqua County - The New York State Department of Environmental Conservation, as lead agency has determined that the proposed Chautauqua County Landfill - 100-Foot High Vertical Expansion may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. The action involves a 33 acre, 100-foot high vertical expansion over the existing 81 acre landfill. The remainder of the existing landfill footprint will be unchanged. The proposed height of the facility will increase from the current design elevation of 1,750 feet to 1,850 feet. The proposal will extend the life of the landfill by about approximately 4.3 years (reaching capacity by approximately June 2012). The Chautauqua County landfill is located at 3889 Towerville Road, in the Town of Ellery, Chautauqua County. The vertical expansion area is located over the currently permitted landfill.

A Draft Scoping Document will be made available for public review and a Public Scoping Session will be held. Details on the date, time and location of the Public Scoping Session will be announced in the future.
