The New York State Department of Environmental Conservation (NYSDEC) administers the Brownfield Cleanup Program (BCP) pursuant to State Environmental Conservation Law (ECL) 27-1400 et seq. The BCP was created to encourage the remediation and redevelopment of contaminated properties known as brownfields. The requestors indicated above have submitted a BCP application for remediation of the site indicated above.

NYSDEC will accept public comments concerning the application. A copy of the application and other appropriate documents (application package) is available in the site document repository located at the address indicated below.

Please note the application package includes the Draft Remedial Work Plan which describes how the contamination related to the site will be addressed. The Final Remedial Work Plan implements the decision document for the remedy selection process for the site.

NYSDEC will review the application package and public comments received and then make a determination on the eligibility of the application.

Negative Declaration

Tompkins County - The Town of Ithaca Planning Board, as lead agency, has determined that the proposed Briarwood II 50-Lot Subdivision will not have a significant adverse environmental impact. The action involves consideration for approval of a proposed 50-lot subdivision located along new extensions to Sanctuary Drive, Birchwood Drive North and Birchwood Drive, Town of Ithaca Tax Parcel No.'s 70-10-3.5 and 73-1-8.22, Medium Density Residential Zone. The proposal includes subdividing the +/- 47.5 acres into 47 residential parcels (averaging 0.4 acres in size) with two parcels totaling approximately 25 acres to be donated to the Cornell Lab of Ornithology, and one small parcel to be added to Salem Drive Park. The proposal involves connecting Sanctuary Drive with Birchwood Drive North, and connecting Birchwood Drive with Sapsucker Woods Road, it also includes development for stormwater management facilities and sidewalks. The project is anticipated to be completed over a 10-year period and result in a development mix of one and two-family dwellings. The project is located on the northeast portion of the Town of Ithaca, west of Sapsucker Woods Road and east and north of Briarwood Drive.
