The
IBM Corp., has applied for permits to install a 12-inch diameter by 1.8 mile long
permanent buried water transmission line, to supply water from the Town of Fishkill to a
number of homes in the "Shenandoah Road Area Water Supply Project." The homes in
this portion of the Shenandoah Road area need a new source of water to replace their
private wells, which are contaminated by an old chemical spill. The water transmission
main, know as "Contract B," is mandated by Administrative Order on Consent
#CERCLA-02-2001-2020.
The
trenching for the installation of this water transmission line would disturb a
portion of the 100-foot wide adjacent area of the following state regulated Freshwater
Wetlands:
HJ-54, Class 1, along Shenandoah Road
HJ-37, Class 2, along Rt 52
HJ-56, Class 2 along Rt 52 in two locations, and
HJ-65 Class 3 along Rt 52
Additionally, the water
transmission line would be installed under the following protected
streams:
H-95-9 Class C-t, and
H-95-8 Class C-t (Wiccopee Creek).
Construction
of this water transmission line water line is located completely outside
of the Shenandoah Road Groundwater Contamination Superfund Site, and thus trenching
for the installation of this water transmission line will not disturb any contaminated
groundwater.
The
proposed water transmission line would be constructed in the shoulder of NYS
Rt 52 and also in the shoulder of Shenandoah Road, primarily in the Town of East
Fishkill, but a short section would be in the Town of Fishkill, in Dutchess County, New
York.

The Department has made
a tentative determination to approve this application for a new
SPDES permit for a proposed surface discharge of 25,000 gallons per day (gpd) of treated
sanitary wastewater into the Indian Kill (Class C) from the Jeffrey Groves Estates
Subdivision. The proposed project involves construction of a wastewater treatment plant
(WWTP) to serve 38 proposed townhouse units and nine (9) single family homes on a
25+ acre parcel. The project is located on the north side of North Cross Road (County
Route 37), approximately 2000 feet west of Reservoir Road in the Town of Hyde Park,
Dutchess County. A draft SPDES permit and stormwater management plan are available
for review at the regional office.

The applicant proposes to
use the existing treatment system which has been out of use for
approximately 12 years. The permittee will be required to maintain records and report
data to verify compliance with the SPDES permit conditions and discharge limits.

DEC proposed effluent limits and monitoring requirements is
available for review at the DEC Region 3 headquarters in New Paltz.

The applicant proposes to
expand an existing horse farm by adding 2 horse barns, 2
outdoor riding rings, an indoor riding ring, multiple paddocks, a maintenance building, a
caretaker cottage, stormwater management basins, and a 2400 gallon per day subsurface
sewage disposal system. The stormwater basins, paddocks, outdoor riding ring, and
access road are proposed to disturb approximately 1.5 acres of the 100-foot regulated
Adjacent Area of NYS Freshwater Wetland L-9, Class I. Disturbance would include
clearing of vegetation and excavation and fill. Approximately 1000 square feet of the
wetland are proposed to be impacted by the placement of an open bottom culvert for the
access road. Approximately 0.15 acre of wetland, currently an old roadbed, is proposed
to be restored and planted with appropriate vegetation. No sewage disposal within the
Freshwater Wetland or 100-foot Adjacent Area is proposed.
The proposed subsurface
sanitary discharge appears to meet the criteria for DEC's
General Permit for Sanitary Discharge of 1,000 - 10,000 gallons per day to Groundwater
(GP-0-05-001).

The applicant proposes to
stabilize approximately 1,300 linear feet of the Hudson River
and Kill Brook shorelines, and construct a new public fishing pier and kayak launching
ramp associated with a waterfront redevelopment project known as Harbor Square. The
project site is located in the Village of Ossining, off Westerly Raod just west of the Metro
North train station. Shoreline stabilization measures will include about 700 linear feet
of
riprap along the Hudson River, and about 390 linear feet of steel sheet pile bulkhead and
180 linear feet of concrete bulkhead along the Kill Brook. The overall development
project includes the construction of a 150-unit residential building, 10,000 square foot
retail building, and associated parking and infrastructure. About 2.7 acres of publicly
accessible open space will be maintained by the project and enhanced through re-establishment of a small
beach, and construction of a fishing pier and kayak launch. A
stormwater pollution prevention plan has been developed in accordance with the
requirements of the SPDES General Permit for Stormwater Discharges from Construction
Activities (GP-02-01). In addition, portions of the site known to contain contaminated
soils are being remediated in accordance with a voluntary cleanup agreement with the
Department.
