Availability for Comment on a Draft Impaired Waters Restoration Plan/TMDL for Acid Rain Lakes

This notice announces the availability of a DRAFT Impaired Water Restoration Plan/Total Maximum Daily Load (TMDL) proposed by the New York State Department of Environmental Conservation for Acid Rain Lakes in the NYS Adirondack Forest Preserve. Public comment on this documents will be accepted for 30 days, through September 15, 2006.

BACKGROUND: States are required by Section 303(d) of the Clean Water Act and USEPA implementing regulations (40CFR Part 130) to develop TMDL plans for waterbodies and pollutants where water quality standards are not being met. By definition, a TMDL specifies the allowable pollutant loading from all contributing sources (e.g., point sources, nonpoint sources, and natural background) at a level necessary to attain the applicable water quality standards with seasonal variations and a margin of safety that takes into account any lack of knowledge concerning the relationship between the sources of the pollutant and water quality. In essence, a TMDL defines the assimilative capacity of the waterbody to absorb a pollutant and still meet water quality standards.

The proposed Impaired Water Restoration Plan/TMDL for these acid rain lakes outlines a "phased" TMDL. Phased TMDLs represent an iterative adaptive management approach. Such an approach is appropriate in situations where the complexity of establishing allowable pollutant loadings creates significant uncertainty and the likelihood that TMDL loadings will be revised as additional information is collected.

Project Description: Six lot subdivision of a 56.8 acre parcel. Project Description: The project is a two lot subdivision involving wetlands and after-the-fact approval of a "wood using facility" (i.e., log concentration yard). The applicants propose to purchase an 8.47 acre parcel containing wetlands and use it as a log concentration yard for the processing of tree length logs. The use involves the receipt of both softwood and hardwood logs to the site, and the sorting and cutting of the logs into various lengths for saw logs, veneer logs, pallet logs, pulpwood and firewood. The processed logs are then shipped off site to various locations using both NYS Route 3 and Route 56 as the primary haul routes. Short sections of logs that are not usable for saw logs, pulp or firewood will be ground on-site and sold along with sawdust and bark as landscaping mulch. The applicants propose that the log concentration yard could be operated 24 hours a day, 7 days a week with the primary hours of operation being Monday through Saturday from 5:00 am to 9:00 pm. Operations at other times will primarily be to make up for lost time and for equipment repairs. Equipment to be used on the site includes a front-end loader with log grapple, three log loaders (two with slasher saws), pick-up trucks, tractor trailers, chain saws and other miscellaneous equipment. The applicants also propose that there could eventually be three structures on the site: a 30 ft. x 40 ft. office, an 80 ft. x 120 ft. shop and a 100 ft. x 100 ft. pole barn for processing firewood. Power will be extended to the site underground. At least a 100 ft. wide vegetation buffer will be maintained between the log concentration yard and Route 3, except for the entrance driveway. One 4 ft. x 6 ft. sign is proposed to be located at the entrance to the site.

Project Description: The action involves a new commercial sand and gravel extraction having a 15.7 acre Life of Mine area of which approximately 5.8 acres are to be disturbed by mining during the next five years. The extraction is to operate annually from April through November, Monday through Friday (no weekends), from 6 a.m. to 6 p.m. A maximum of 50,000 cubic yards of sand and gravel is to be removed from the extraction per year. An average of 20 and a maximum of 50 loaded daily truck trips are expected. Material processing will involve the use of a portable crushing plant. A mining permit application for this project has also been submitted to the New York State Department of Environmental Conservation.
