The Department has prepared
a Draft Permit and has made a tentative determination to
approve this application for an Air State Facility permit pursuant to Article 19 (Air
Pollution Control) of the Environmental Conservation Law (ECL). The facility operates
internal an combustion engine fueled by landfill gases to generate electricity. The
facility's potential to emit (PTE) oxides of nitrogen (NOx) no longer exceeds the major
facility threshold of 25 tons per year (tpy). The proposed State Facility Permit caps NOx
emissions at the facility to less than 22.5 tpy. The facility has agreed to accept permit
conditions that will limit facility wide emissions of oxides of nitrogen at 22.5 tons per
year. The decrease in emissions is due directly to the decrease in landfill gases generated
by the landfill. By accepting these state and federally enforceable limits the facility will
not be subject to the provisions of the Title V operating permit program. The application
and the draft permit are available for review at the Region 1 office in Stony Brook. The
facility is located at the Oceanside Landfill, Long Beach Rd. and Mott Ave. in the Hamlet
of Oceanside, Town of Hempstead, Nassau County

The applicant proposes to create an area
of intertidal and high marsh from an upland
area in an existing cove. Five hundred thirty-two cu. yds. of material will be excavated
from the approximately 45' x 60' area. The area will then be lined with geotextiles and
planted with native wetland species to stabilize the slopes. An 8' x 107' pier with an
irregular 24' x 36' observation platform will be constructed across the newly created tidal
marsh. Upland improvements including an asphalt parking lot, concrete paths, crushed
oyster shell paths, and a pavilion are also proposed. The purpose of the project is to
create tidal marsh habitat, provide facilities for a marine education program, and make
aesthetic improvements to an area to be used for passive community recreation. The
project is located on the north side of West End Avenue at its terminus at Oyster Bay
Harbor in Oyster Bay Hamlet in the Town of Oyster Bay, Nassau County, NCTM# 27-A-5, 33,222 & 223. The Department has made a tentative determination to issue a Tidal
Wetlands permit for the proposed project under Article 25 of the Environmental
Conservation Law and has prepared a draft permit. This tentative determination
indicates that the project is considered to satisfy regulatory standards for permit
issuance, based on information available to the Department at this time. As a tentative
determination, the Department seeks comments on the proposed regulated activity prior
to making a final decision on permit issuance. As such, this tentative determination
does not signify Department approval for, or endorsement of, the activity for which a
permit is sought or for the overall proposed project.
