The applicant proposes to construct a 48' x26' modular residential home on the site of a previous mobile home.  The residence would be located within 70' of state regulated freshwater wetland

S-1, an 1117 acre Class II wetland, associated with Black River Bay.  The site is located at 22113 Cronk Road, off Storrs Harbor Road, approximately 1.5 miles east of the Village of Sackets Harbor.

The applicant proposes to construct a roadway approximately 1100' long x 20' wide to access a three lot recreational subdivision.  The roadway would cross approximately 40' of state regulated freshwater wetland BR-2, a 24.1 acre Class IV predominately coniferous wetland.  The wetland is a wet meadow covertype at the crossing site.  The site is located approximately 400' south of Van Arnam Road, 0.85 miles east of Eatonville Road, 2 miles west of Brantingham.

The Department has initiated a modification of the City of Utica's Combined Sewer Overflow (CSO) SPDES permit.  The City owns and operates a combined sewage system which discharges to the Oneida County Water Pollution Control Plant (WPCP) during normal, dry weather flows.  The County's SPDES permit is currently being modified to incorporate updated CSO requirements.  Therefore it is now necessary to make several modifications to the City's permit which are consistent with the new requirements which will be contained in the County's modified SPDES permit.  

A summary of modifications to the City's permit include:

  -Recognition of the fact that the permittee has fulfilled the Best Management Practice (BMP) permit requirement to submit a written maintenance and inspection program for all CSOs.

  -Deletion of the BMP requirement to maximize flow to the Water Pollution Control Plant (WPCP), since this function is the responsibility of the County.

  -Deletion of the BMP reference to General Conditions (Part II) of the SPDES permit, since these conditions are now incorporated into the recently revised 6 NYCRR Part 750 SPDES regulations.

  -Removal of BMP language that requires septage and hauled waste to be discharged only at the County WPCP, since the County determines who can make this type of disposal at its facility.

  -Recognition of the fact that the permittee has fulfilled the LTCP requirement for submittal of a combined sewer system characterization, monitoring, and modeling plan.

  -The public participation plan section of the LTCP requirements was substantially expanded to enhance coordination and cooperation between the permittee and Oneida County in the tasks involved with characterizing, investigating, and evaluating the issues related to the permittee's CSOs and the alternatives for minimizing and/or eliminating the issues associated with them.
