The applicant proposes a
discharge of .78 million gallons per day of treated wastewater to
Dodge Creek at the confluence with Allegheny River, a Class C waterbody, at the
applicant's facility located off Main Street in the Village of Portville, Cattaraugus County.
All existing process limits are proposed to be upgraded which includes ultraviolet
disinfection. This is an Environmental Benefit Permit Strategy (EBPS) modification with
a score of 69. The Department has made a tentative determination to issue a permit for a
State Pollutant Discharge Elimination System permit under Article 17 of the
Environmental Conservation Law. This tentative determination indicates that the
discharge regulated under this statute is considered to satisfy regulatory standards for
permit issuance, based on information available to this Department at this time. The
Department seeks comments on the proposed regulated activity prior to making a final
decision on permit issuance. As such, this tentative determination does not signify
Department approval for or endorsement of the activity for which a permit is sought or
for the overall proposed project. The application is available for review at the office listed

Cassadaga Well Field to replace existing Well No. 6, which is to be abandoned due to
inefficiency. The replacement well will operate at a rate not to exceed 700 gallons per
minute, which is equivalent of the rate currently authorized for Well No. 6. Total
permitted production for the Cassadaga Well Field, 10 million gallons per day, will not
change. The well development includes installing production equipment, pipeline and a
well head protection building in the 100-foot Adjacent Area of Freshwater Wetland No.
GE-14.

The proposal is a USDA/NRCS Wetland Reserve
Program (WRP) project to restore and
enhance wetlands that were altered by previous farming on about 12.2 acres in State
regulated Freshwater Wetlands #EC-2 and CS-10, the wetlands 100-foot Adjacent
Areas and upland of the wetlands. The project involves restoring aquatic and emergent
wetland habitat by constructing a complex of potholes with connecting level ditches to
create open-water areas for waterfowl habitat. Spoil material will be placed upland
and/or in a 4-foot wide berm adjacent to the pothole. The total WRP permanent
easement site is 220 acres. Access to a portion of the WRP project site involves
crossing Mill Creek at an existing farm equipment ford. The project site is located along
the northwest and southeast sides of County Rte. 66 about 2,500 feet northeast of
County Rt. 380 in the Town of Gerry.

The applicant is proposing
waterline installation for the previously created Town of
Newstead Water District No. 10. The project involves the installation of approximately
46,500 linear feet of 8-inch PVC waterline and associated appurtenances along road right-of ways. Installation
will be within the regulated 100 foot wide adjacent areas of the
following NYS regulated Freshwater Wetlands: WO-27 along Tonawanda Creek Road;
W0-22 along Greenbush Road; and AK-9 along Cedar Street. In addition, the waterline
installation will cross the following protected streams: Ledge Creek, (Class/Standard B)
along Martin Road and Cedar Street; and a tributary of Dorsch Creek along Millgrove
Road.

Construct Phase II of the Eighteenmile Creek Streambank
Stabilization & Habitat Restoration Project at Fisherman's Park on the west side of Route
78. The project consists of the placement of large riprap stones along both banks to
redefine and narrow the channel and to create a wetland area the east creek bank.
Hydraulic cover stones would also be placed in the creek and wetland vegetation restored.
This work would extend from the main access ramp from the parking lot upstream
approximately 560 feet.
