The applicant proposes to
dredge an existing pond within a state designated freshwater
wetland WD-15 (class II). The project site is a 1.3 acre pond located on the south side of
Coldenham Road about 0.7 mile east of the intersection with NYS Route 208.
Approximately 4,200 cubic yards of accumulated silt and sediment will be removed from
the pond and placed on-site outside the regulated wetland and 100-foot adjacent area,
where it will be graded and stabilized with vegetation.

DEC has tentatively determined
to issue a draft State Pollutant Discharge Elimination System (SPDES) permit to Meadow
Creek Development, LLC for discharge of sanitary wastewater from a the proposed Orchard Hills subdivision
wastewater
treatment plant (WWTP.) The project site is located in the Town of Newburgh/Middlehope, Orange County,
off NYS Route
9W, north of Oak Street. The draft SPDES permit authorizes a discharge of 120,000 gallons per
day to a Class C unnamed
tributary of the Hudson River. The permit contains effluent limits for Flow, BOD, Temperature, Suspended
Solids, Settleable
Solids, Dissolved Oxygen, Nitrogen, Fecal Coliform, pH and Total Residual Chlorine. The
WWTP, when constructed, will
serve the proposed Orchard Hills 272-unit subdivision and will also serve the existing 150-unit Apple
Valley Apartment
complex, located west of the site across NYS Route 9W. The current SPDES permit for the Apple
Valley Apartment complex
will remain in effect until diversion is effectively complete. DEC will discontinue the SPDES
permit upon request of the
permittee after successful decommissioning of the existing WWTP on the Apple Valley site.

treat up to 7 acres of Brown's Pond, which totals about 11.72
acres, with the aquatic pesticides Aquathol-K (active ingredient: endothall) and AquaPro
(active ingredient: glyphosate). The treatment site is located on Brown's Pond along the
north side of Mooney Hill Road, approximately 600 feet east of the intersection with
Luddingtonville Road in the Town of Kent. The purpose of the treatments is to control
nuisance aquatic vegetation Nuphar sp. (pond lilies) and Ceratophyllum demersum
(coon's tail). The treatment area is also a portion of State-designated Freshwater Wetland
LC-6 (Class II).

construct an addition to an existing single family residence
within the 100-foot adjacent area of State-designated Freshwater Wetland K-21 (Class II).
The project site is located on the west side of Byram Lake Road, approximately 0.5 mile
south of the Interstate 684 overpass. Construction within the 100-foot adjacent area will
include the 600 square foot addition, a deck measuring about 15 feet square, the
installation of two subsurface stormwater infiltration fields totalling about 1,300 square
feet, and driveway resurfacing. All improvements will occur within existing lawn areas.
