The Department has prepared
a Draft Permit and has made a tentative determination to
approve this application for renewal of an existing Air Title V Permit. The facility
operates flexographic printing equipment for manufacturing lables for consumer and
industrial products.
In accordance with 6NYCRR
Parts 621.5(d)(9) and 201-6.4(c), the Administrator of the
United States Environmental Protection Agency (USEPA) has the authority to bar
issuance of any Title V Facility Permit if it is determined not to be in compliance with
applicable requirements of the Clean Air Act or 6NYCRR Part 201.
Persons wishing to inspect
the subject Title V files, including the application with all
relevant supporting materials, the draft permit, and all other materials available to the
DEC (the "permitting authority") that are relevant to this permitting decision should
contact the DEC representative listed below. It is recommended that an appointment be
made to confirm the availability of the subject files. The DEC will endeavor to make the
files available within 2 business days of contact, during normal business hours (8:30 am
through 4:45 pm), unless the requestor wishes to inspect the files at a later date. The
Draft Permit and Permit Review Report may be viewed and printed from the Department
web site at: http://www.dec.state.ny.us/website/dar/boss/afs/index.html.
DEC will evaluate the application
and the comments received on it to determine whether
to hold a public hearing. A public hearing may be legislative or adjudicatory. A
legislative public hearing is a proceeding which provides an additional opportunity for
public comment. DEC's determination to hold a legislative public hearing will be based
on whether a significant degree of public interest exists. If a legislative public hearing
is
to be held, a Notice of Hearing will be published which will include the time and place of
the hearing and submitting comments. The applicant and all persons who have filed
comments on the permit will be notified by mail of the public hearing. Comments and
requests for a legislative public hearing should be in writing and addressed to the
Department representative listed below.
An adjudicatory public hearing
is a trial type proceeding which provides the opportunity
for adjudication on the basis of evidence, including direct testimony and cross
examination. An adjudicatory hearing is held only if substantive and significant issues
relating to any findings or determinations the Department is required to make pursuant to
the Environmental Conservation Law exist. A copy of the Department's permit hearing

The
Department is proposing to modify the SPDES permit for the Port Jefferson Power
Station located on the west shore of Port Jefferson Harbor, part of Long Island Sound.
The Port Jefferson Power Station currently operates Units 3 and 4, which became
operational in 1958 and 1960 respectively. In 1996 Unit 3 was converted to dual-fuel
use ( #6 oil or natural gas). Unit 4 was converted in 1997. Each unit has a maximum
generating capacity of 175 megawatts. In addition to these steam units there are three
combustion turbines on site that can produce up to a total of 95.9 megawatts.
Units
3 and 4 are cooled by a once-through system that draws water from Port
Jefferson Harbor through a shoreline intake structure located landward of a docking
facility currently used by vessels making oil deliveries to the station. The system consists
of two cooling water circulator pumps per unit with a combined rated capacity of 204,000
gallons per minute (GPM) or 294 million gallons per day (MGD), four conventional
vertical traveling screens with 0.375 inch mesh, and four vertical trash racks with 3 inch
bar spaces. The discharge of cooling water from the Port Jefferson Station Units 3 and 4
is through a surface outfall south of the intake structure, located at the shoreline, into
Port Jefferson Harbor.
This
SPDES permit authorizes the discharge of non-contact cooling water, evaporator
blowdown, condensed steam, intake bay dewatering effluent, treated wastewater, and
storm water to Port Jefferson Harbor. The modifications to the SPDES permit being
contemplated by the Department includes an update of monitoring information, and
requires KeySpan to submit data and analyses related to the once-through cooling system.
The information will be utilized by the Department to determine best technology
available for minimizing adverse impacts to the aquatic resources of Port Jefferson
Harbor. KeySpan will also be required to review possible technologies and operational
measures to minimize aquatic impacts. The information is being requested pursuant to 6
NYCRR Part 704.5 and 40 CFR 125 - Subpart J.

The Department has made a tentative determination
to issue a permit for a State
Pollutant Discharge Elimination System permit under Article 17 of the Environmental
Conservation Law. This tentative determination indicates that the discharge regulated

based on information available to the Department at this time. As a tentative
determination, the Department seeks comments on the proposed regulated activity prior
