Conditioned Negative Declaration

Steuben County - The Town of Bath Planning Board, as lead agency has determined that the proposed Pilot Travel Center, LLC will not have a significant adverse environmental impact provided specific conditions are met. There will be a 30 day public comment period commencing with the date of this notice. The action involves the applicant proposing to development of an 11.9 acre parcel to accommodate a PILOT TRAVEL CENTER on Route 53, Kanona, Steuben County, New York, in the Town of Bath, on the southwest quadrant of Route 53 and I-86 intersection. The project is to include gas and diesel pumps and tanks, convenience store, Subway Restaurant, parking for cars and tractor trailers, laundry facilities, shower facilities and wastewater treatment. The proposed development will affect approximately 8.0 acres of the 11.9 acres of the project parcel.

The conditions are:

1. The potentially large impact on surface or groundwater quality can be mitigated by complying with the NYS Department of Conservation SPDES permit.

2. The potentially large impact by the storage of petroleum or chemical products greater than 1,100 gallons can be mitigated by receiving a permit from NYS Department of Conservation for fuel storage.

3. The small to moderate impact to an archaeological site or fossil bed located within the project site can be mitigated by receiving a release from the NYS Office of Parks, Recreation and Historic Preservation (OPRHP).

4. The small to moderate impact to existing transportation systems can be mitigated by applicant providing a traffic study to and receiving from the NYS Department of Transportation a highway work permit.

Negative Declaration

Monroe County - The Penfield Town Board, as lead agency, has determined that the proposed Villas at Easthampton, will not have a significant adverse environmental impact. The action involves an application for Incentive Zoning, Subdivision and Site Plan approval for construction of 124 townhouse units on 55.87 acres, currently zoned RR-1. The property contains a tributary to Mill Creek, federally designated wetlands and a locally designated Woodland Environmental Protection Overlay District. The project is located at 1046 State Road, Penfield (T).
