The Department has prepared
a Draft Permit and has made a tentative determination to
approve this application for an Air State Facility permit pursuant to Article 19 (Air
Pollution Control) of the Environmental Conservation Law (ECL). The facility operates
internal an combustion engine fueled by landfill gases to generate electricity. The
facility's potential to emit (PTE) oxides of nitrogen (NOx) exceeds the major facility
threshold of 25 tons per year (tpy). The proposed State Facility Permit caps NOx
emissions at the facility to less than 22.5 tpy. The facility has agreed to accept permit
conditions that will limit facility wide emissions of oxides of nitrogen at 22.5 tons per
year. The decrease in emissions is due directly to the decrease in landfill gases generated
by the landfill. By accepting these state and federally enforceable limits the facility will
not be subject to the provisions of the Title V operating permit program. The application
and the draft permit are available for review at the Region 1 office in Stony Brook. The
facility is located at the Smithtown landfill Gas Recovery Facility on Old Northport and
Commack Road, in the Hamlet of Kings Park, Smithtown, Suffolk County.

gallons per day of sanitary wastewater and
1 gallon per day of boiler blow down wastewater to groundwater from the applicant’s
facility located at 49 Mall Drive, Commack. The applicant plans to operate a non-manufacturing
pharmaceutical development center.
The Department has made a tentative determination
to issue a permit for a State
Pollutant Discharge Elimination System permit under Article 17 of the Environmental
Conservation Law. This tentative determination indicates that the discharge regulated
under this statute is considered to satisfy regulatory standards for permit issuance,
based on information available to the Department at this time. As a tentative
determination, the Department seeks comments on the proposed regulated activity prior
to making a final decision on permit issuance. As such, this tentative determination
does not signify department approval for, or endorsement of, the activity for which a
permit is sought or for the overall proposed project.
