ENB Region 8 Completed Applications 06/21/2006

The applicant has applied for a modification to add 46.6 acres to the present 152.6 acre life-of-mine area of the Ogden Quarry facility.  Within the 46.6 modification area, approximately 32.4 acres would be included as an area permitted for the removal of consolidated bedrock.  The mine will continue to operate as both a traditional surface excavation of sand and gravel overburden, utilizing the mechanical and hydraulic equipment currently in use on the site, and as a open, dolomite rock quarry, with rock removal by standard drill and blast techniques.  No changes to the current excavation methods, aggregate processing, rates of mining, truck traffic and other operational details of the quarry are proposed.  Final reclamation of the modification area will be to an open water lake with stabilized and re-vegetated perimeter slopes.

The applicant proposes the construction of a 8' x 60' permanent open pile dock on the Lake Ontario shoreline. The dock is proposed to be located in the regulated New York State Freshwater Wetland  PM-2 adjacent area and in the Coastal Erosion Hazard Area.

The applicant proposes the construction of a 12 lot residential subdivision, including a 12"sanitary sewer connection located north of Shoecraft Road. The installation of the sanitary sewer will include the temporary disturbance of 0.298 acres of NYS Freshwater Wetland PN-12. The area of temporary wetland disturbance will be planted with wetland species following installation of the sanitary sewer. Additionally, the construction of the required stormwater pond outfall will impact 0.019 acres of wetland adjacent area.

The Town of Shelby proposes to create the Town of Shelby Water District #8 and to take for use therein a supply of water estimated to average 10,454 gallons per day from the Niagara County Water District's Niagara River source via the Village of Medina. The project includes the installation of 6,400 linear feet of 12-inch and 15,800 linear feet of 8-inch water main and appurtenances to serve 53 existing residences and future development. The Department has made a tentative determination to approve this application, but is seeking public comments prior to making a final decision on permit issuance. A draft permit is available for review and comment at the regional NYSDEC office in Avon.

The applicant proposes to replace an old retaining wall with 120 lineal feet of new timber wall, install rip rap along 210 lineal feet of streambank and remove  approximately 195 cubic yards of gravel while reshaping the stream bed to maintain the existing low flow channel in the Class C(ts) stream, Plum Creek.  The project is to protect the existing building on the applicant property located at 3491 Plum Point Rd., in the Town of Milo, Yates County.
