Applicant proposes to redevelop
a 32,623 square foot parcel containing an existing
marina with a nine unit, residential condominium development. The work includes the
removal of existing boat ramps, marine railways, boardwalks and other structures
associated with the marina use, the construction of one building to contain seven units
and a second building to contain two units. A paved access drive, site drainage system,
900 square feet of floating docks and two planted buffer areas are also included. As
proposed, this project requires variance relief from the following development restrictions
of 6 NYCRR Part 661.6 (Tidal Wetlands Land Use Regulations): A.
Principal
building minimum 75 foot wetland setback requirement. The two proposed buildings will
be within 13 feet and 17 feet of the wetland boundary. B. 75 foot minimum wetland
setback requirement for hard surface driveways and parking areas. At the closest point,
the proposed access drive will be ten feet from the wetland boundary. C. 20% maximum
adjacent area coverage limit for impervious structures. Proposed adjacent area coverage is
approximately 51%. D. Maximum allowable development density of two units per 20,000
square feet of lot area. With lot area of 32,623 square feet, the maximum number of units
should be three. Nine units are proposed. The site is located on Bellmore Creek, at the
south end of Public Highway in Bellmore. NCTM # 63-219-10.

The applicant proposes to
construct 141 feet of bulkhead and place 100 cubic yards of
clean backfill. A portion of the proposed bulkhead will be installed seaward of apparent
high water and will result in the filling of tidal wetlands. Construct a 12 foot by 23 foot
boat ramp consisting of two 2.5 foot by 34 foot concrete strips, sand and pea gravel, and
the ramp will have timber sidewalls. Ten feet of the proposed ramp will be installed
seaward of apparent high water and will result in the filling of tidal wetlands. A 35.5 foot
low sill bulkhead is proposed on the eastern portion of the shoreline and will run along
the seaward edge of the proposed boat ramp. Rocks are proposed to be placed along the
shoreline landward of the low sill bulkhead and the area planted with Spartina
alterniflora. Additional plantings of shrubs and plants are proposed along the remainder
of the shoreline. A 4 foot by 20 foot float and two mooring piles having davits are
proposed along the seaward face of the low sill bulkhead. The project is located at 6
Night Heron Drive, Stony Brook, Brookhaven Town, SCTM #200-130-2-4.
