Applicant proposes to mine
sand and gravel from a 3 acre knoll area located within its
350 acre farm property. The knoll to be removed contains the remnants of a former one
acre mine. A one acre recreational pond with a maximum depth of 15 feet will be
excavated as part of the mining operation. Approximately 50,000 cubic yards of material
will be excavated and used on the farm or removed for off-site purposes. The mine area
is located south of NYS Route 199 and east of Schultz Hill Road.

The Department has made
a tentative determination to approve this application for
modification to existing SPDES permit # NY-0148601 for Whispering Woods (formerly
known as Lazy G Campground), located on Rosemond Rd in Woodridge, to discharge up
to 30,000 gallons of treated wastewater per day to an unnamed tributary of the West
Branch of the Beerkill (Water Index # H-139-14-38-3-1-6; Class B(t)). A draft SPDES
permit with DEC proposed effluent limits and monitoring requirements is available for
review at the DEC Region 3 headquarters in New Paltz. The permittee will be required to
maintain records and report data to verify compliance with the SPDES permit conditions
and discharge limits.
The applicant proposes to
replace the current treatment system which discharges 6600
gallons of treated wastewater per day into an unnamed tributary of Silver Lake (Water
Index # H-139-14-38-P807-4, Class D). The current sand filters and outfall are less than
100 feet from existing dwellings. The existing system will be abandoned in place as soon
as the proposed system is in operation.
The upgrade in sewer capacity
is part of a proposed facility expansion which will remove
the existing travel trailers and test sites and add an additional 68 double wide home
trailers. Construction of the proposed sewer outfall will disturb no more than 20 feet of
the unnamed tributary of the West Branch of the Beerkill.

construct a 4 foot by 200 foot catwalk as an access to Highland
Lake. The catwalk is proposed to be at least 1 foot above the wetland surface and the
boards of the decking to be spaced at least 1 and half inches apart. The project site is
adjacent to and within Freshwater Wetland HL-50 (Class II) on the west side of Highland
Lake, east of Hartung Road.
