construct the new Harbour Heights housing development
which would impact 0.32 acres of state wetland BAL-15 and 1.83 acres of its 100 foot
adjacent area. The majority of the impact is justified as a roadway access through the
wetland. Also, the applicant proposes to relocate an intermittant stream to the Senaca
River which involves placement of fill over 218 square feet below the mean high water
level and rock rirprap at the new outfall. Project plans are available for review in the
Syracuse Office.

Nine Mile Point Nuclear
Station, LLC submitted a 401 Water Quality Certification Application to the Department in June 2005
in association with the federal relicensing of the Nine Mile Point Nuclear Station by the Nuclear Regulatory
Commission
(NRC) for a twenty year period. The Department has made a tentative determination to issue the
401 Water Quality Certificate
for the proposed additional twenty year term. The Department will reevaluate the facility on a
five year basis during the
renewal of the SPDES permit. The application material and a draft 401 Water Quality Certification
is available for review and
comment.
