|
The applicant proposes to
disturb 150 linear feet of the 100-foot regulated Adjacent Area
of Freshwater Wetland NB-32, Class 1, for the construction of a 20 foot wide private road
to service a new subdivision. An additional 280 linear feet of the Adjacent Area will be
disturbed during re-grading and re-vegetating of an existing 10 foot driveway. The
existing 23 acre lot with 1 existing single family home is proposed to be subdivided into
5 lots with 4 new homes proposed. All proposed disturbance associated with
constructing the new homes and their associated wells, septics, and driveways is located
outside the NYS regulated area.

The applicant proposes to
restore approximately 0.30 acres (13,000 square feet) of salt
marsh and 0.30 acres (13,000 square feet) of upland area in West Basin, Harbor Island
Park, Village of Mamaroneck. The area contains NYS regulated Tidal Wetlands
(Intertidal Marsh and Littoral Zone) and Adjacent Area. Portions of the shoreline marsh
were filled sometime prior to the enactment of 6 NYCRR Rules and Regulations Part
661, Tidal Wetlands.
Approximately 400 linear
feet of shoreline will be excavated and re-graded. Debris and
some existing trees will also be removed from this area prior to grading. The re-graded
slope below mean high water will be planted with suitable low and high marsh plants.
Above mean high water, plantings will consist of appropriate upland grasses, shrubs, and
trees. The remaining upland area will be cleared of invasive stands of common reed
(Phragmites australis) and Tree-of-Heaven (Ailanthus altissima), followed by treatment
with pesticide to prevent re-occurrence. The area will then be established as lawn, with a
line of shrubs along the southeast boundary of the property.
Approximately 1400 linear
feet of 5 foot wide gravel walking trail and a 16-20 foot oval
lookout point will be placed within the Adjacent Area to allow public access to the site.
Two gravel paths of 25-30 feet each and a set of stone steps will be placed within the
Tidal Wetland as well. Existing boulders and approximately 220 feet of existing riprap
will be removed from the marsh restoration area and utilized in the proposed stone steps
and lookout, or incorporated into repairs to the existing 165 foot concrete and boulder
revetment to remain.
All existing areas of cordgrass (Spartina
alternifolia and Spartina patens) will be
protected and remain undisturbed. A waterfowl fence will be erected around the restored
marsh to prevent disturbance until full established.
