This Department has received
a request to modify an existing permit and has drafted an
Article 19 (Air Pollution Control) of the Environmental Conservation Law, an Air State
Facility Permit, at the facility located at Remington Arms Company, 14 Hoefler Avenue,
Ilion, New York 13357. This facility is primarily engaged in the manufacture of small
firearms and components thereof. A secondary operation is the manufacture of
commercial products through the application of powdered metal technology. This State
Facility Permit modification consists of incorporating the operations of the 90 mmbtu/hr
auxiliary boiler from the former adjacent NRG-Ilion Steam Plant, located at 11
Remington Avenue in Ilion, NY. The auxiliary boiler uses natural gas as the primary
fuel, and kerosene and No. 4 fuel oil as the backup fuels. The facility is limited to 99.0
tons per year of NOx and SO2. The auxiliary boiler is subject to the 40 CFR 60, Subpart
Dc. The draft permit with conditions is available for review in the Region 6 NYS DEC
office in Watertown, New York.

This Department has received
a request for a permit renewal to operate air pollution
sources and has drafted pursuant to Article 19 (Air Pollution Control) of the
Environmental Conservation Law, a Title V Facility Permit, for the DANC Solid Waste
Management Facility located in the Town of Rodman, Jefferson County, New York. The
facility is a landfill that accepts municipal solid waste. The Standard Industrial
Classification representative of this facility is 4953, Refuse Systems.
The facility commenced receiving
waste in 1992 and has emissions of air contaminants
required to comply with certain provisions of 40 CFR 60 Subpart WWW. The facility
currently utilizes a landfill gas collection and control system for controlling off-site odors.
The main control is a large flare that burns landfill gas from the collection and control
system. In the near future the collected landfill gas will be piped to a separate facility
(Innovative Energy Systems - IES) that will burn the landfill gas in internal combustion
engines and sell the generated power to the grid. The large flare will remain as a backup
in case the IES engines are unable to accept the landfill gas. The facility also operates up
to 8 candlestick flares for additional control of landfill gas odors as needed. In addition
the facility operates exempt and trivial activities including emergency generators, fuel
storage tanks, building heaters, waste oil storage, and mobile equipment.
Persons wishing to inspect
the subject Title V files, including the application with all
relevant supporting materials, the draft permit, and all other materials available to the
DEC (the "permitting authority") that are relevant to this permitting decision should
contact the DEC representative below. It is recommended that an appointment be made
to confirm the availability of the subject files. The DEC will endeavor to make the files
available within 2 business days of contact, during normal business hours (8:30 a.m.
through 4:45 p.m.), unless the requester wishes to inspect the files at a later date.
DEC will evaluate the application
and the comments received on it to determine whether
to hold a public hearing. A public hearing may be legislative or adjudicatory. A
legislative public hearing is a proceeding which provides an additional opportunity for a
public comment. DEC's determination to hold a legislative public hearing will be based
on whether a significant degree of public interest exists. If a legislative public hearing is
to be held, a Notice of Hearing will be published which will include the time and place of
the hearing and submitting comments. The applicant and all persons who have filed
comments on the permit will be notified by mail of the public hearing. Comments and
requests for a legislative hearing should be in writing and addressed to the Department
representative listed below.
An adjudicatory public hearing
is a trial type proceeding which provides the opportunity
for adjudication on the basis of evidence, including direct testimony and cross
examination. An adjudicatory hearing is held only if substantive and significant issues
relating to any findings or determinations the Department is required to make pursuant to
the Environmental Conservation Law exist. A copy of the Department's permit hearing
procedures is available upon request or on the Department's web site at:

In accordance with 6NYCRR
Part 621.5(d)(9) and 201-6.4(c), the Administrator of the
Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title
V Facility Permit if it is determined not to be in compliance with applicable requirements
of the Clean Air Act or 6NYCRR Part 201. After the public comment period, the
USEPA will be provided a proposed permit and will have an additional 45 day period for
review. If USEPA does not raise any objection, the Department will issue the permit.

in Watertown, NY.

The applicant proposes to
modify the existing mining permit to include mining below the
local water table a parcel of land totaling 100.0 acres, east Murphy Road. The project site
is on parcels of property owned by Thomas Tkachuk and is located 500 feet east of
Murphy Road and ½ mile north of Oneida County Route 67. The mine is intended to
operate as traditional sand and gravel mine with mining is proposed to eventually take
place below the local water table. Excavation of the sand and gravel will be done by front
end loaders and tracked excavators, standard for sand and gravel mining operations.
Mining is proposed to remove approximately 1,100,000 cubic yards of sand and gravel
over the operational life of the mine. Material will be excavated and then processed with
portable crushers and screens. Maximum processing rates for the screen and crushing
operations are expected to exceed 150 tons-per-hour (TPH) and all necessary air permits
will be obtained. Final reclamation will restore the site to a 31.4 acre lake and upland
open meadow with uniformly graded and re-vegetated open land. Up-land reclamation
will include the replacement of stockpiled topsoil, and re-seeding with an approved
USDA SCS seed mixture. The reviewed life-of-mine area is 31.4 (LOM) acres.
