Consolidated SPDES Renewals
The New York State Department of Environmental Conservation (NYSDEC) administers the Brownfield Cleanup Program (BCP) pursuant to State Environmental Conservation Law (ECL) 27-1400 et seq. The BCP was created to encourage the remediation and redevelopment of contaminated properties known as brownfields. The requestor indicated above has submitted a BCP application for investigation of the site indicated above.
NYSDEC will accept public comments concerning the application. A copy of the application and other appropriate documents (application package) is available in the site document repository located at the address indicated below.
NYSDEC will review the application package and public comments received and then make a determination on the eligibility of the application.

Orleans County - The County of Orleans Industrial Development Agency, as lead agency, has determined that the proposed Western New York Energy, LLC will not have a significant adverse environmental impact. The action involves Western New York Energy (the “Applicant”) proposing the construction of an ethanol manufacturing facility that will generate 57.75 million gallons of denatured ethanol per year. The new agri-business development is on a 145 acre site located in the Town of Shelby, Orleans County, New York. In addition to the on-site construction, there will be several items off-site that are necessary to facilitate construction. These off-site improvements will include the installation of piping necessary to provide public water to the facility from the Niagara County Water District, facilities to enable the discharge of process water to Oak Orchard Creek, the extension of gas, electric, telephone and data services, and the extension of rail from the main line. The project is located on the Northeast Corner of NYS Routes 31A and Bates Road, Town of Shelby, Orleans County.

Steuben County - The Steuben County Industrial Development Agency, as lead agency, has determined taht the proposed Airtricity Steuben Wind Development Project may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. The action involves construction of 22 ± wind turbine units for the purpose of generating 50-55 megawatts of electricity. The project is located in the Towns of Hartsville and Hornellsville, Steuben County, NY.
