The Department has drafted
an Air State Facility (ASF) Permit pursuant to Article 19
(Air Pollution Control) of the NYS Environmental Conservation Law (ECL) and Federal
Clean Air Act Amendments and made a tentative determination to approve this
application for Nestle Purina PetCare Company's pet food manufacturing facility located
at 3800 Middle Road to allow for greater flexibility in terms of fuel usage at the facility.
The facility is currently operating under an Air Facility Registration (AFR). Under the
AFR, the facility was capped by rule in order to avoid Oxides of Nitrogen (NOx)
Reasonably Available Control Technology (RACT) requirements and major facility, Title
V permitting. Natural gas has been the facility's main source of fuel. The firm now
desires greater flexibility by burning both No. 6 oil and natural gas. This will require a
higher emission cap than is allowed by the AFR cap-by-rule limitation. To accomplish
this higher cap limit, the firm submitted an application for an ASF Permit. The draft ASF
Permit includes a Federally enforceable emission cap limiting Sulfur Dioxide (SO2)
emissions based on fuel usage. NOx emissions are also limited below the major source
and NOx RACT applicability threshold. The facility will remain minor for New Source
Review for both NOx and SO2.

As part of Phase IV of the
River Meadows Subdivision, it is proposed to construct a
1.004 acre detention pond of which approximately 0.75 acre will be within the regulated
100 foot wide adjacent area of the Grand Island Boulevard (TW-9) Wetland, a class I
wetland. The detention pond is needed to comply with the new Stormwater Phase II
permit criteria. The River Meadows Subdivision is located west of Baseline Road just
south of Woods Creek.
