ENB Region 8 Completed Applications 05/10/2006

The applicant proposes to undertake a project to correct a problem with the plugging of a road culvert, (4ft. x 2 ft. box culvert) on State Route  427 at Marker 6201.1060, which has resulted in flooding of the roadway. The culvert is associated with an intermittent unnamed stream, which has a NYS Surface Water Classification of Class C. Erosion within the drainage basin and the presence of steep slopes immediately upstream of the culvert location combined with a change to relatively flat terrain at the road way and downstream from culvert, where no distinct channel exists, has resulted in the accumulation of eroded sediments and the blockage of the culvert. To correct the problem, the applicant proposes to install a new larger box culvert (6 ft. x 2.5 ft.) which will be repositioned to improve alignment with upstream stream channel and grade. Stream channel modifications will be employed to reduce stream erosion, to protect the new culvert,  to allow improved passage of stream flow and to stabilize a defined channel. Stream channel modifications upstream of the new culvert will consist of minor realignment of less than 100 ft of stream channel and the placement of heavy stone fill along 114 ft of stream channel. Downstream from the new culvert to the downstream railroad culvert, a new 323 ft. long stream channel will be constructed. Heavy stone fill will line the first 120 ft of the channel downstream of the culvert, followed by 33 ft. of channel lined with medium stone fill and the last 170 ft of the new channel would be grass covered naturally occurring material. In total, the applicant estimates the project will result in excavation of 1420 cubic yards of material and the addition 384 cubic yards of rock fill below the ordinary high water elevation of the stream. The applicant will be required to employ sediment and erosion control measures to prevent the contravention of the surface water quality standards applicable to Class C waters of New York State.

The applicant proposes to construct a single family dwelling at their property located at 36 North Lake St. in the Village of Bergen, Genessee County.  The house will be built in a previously disturbed, mown area located within the adjacent area of state regulated, Class 2 Freshwater Wetland, CH-8.

The applicant proposes the renewal of a one-time treatment to 10 acres of Horseshoe Lake with the aquatic herbicide Reward.  The application is intended to control curly-leaf pond weeds, considered nuisance, invasive aquatic plant species.  The herbicide will be applied as a surface application by power sprayer at a rate not to exceed 1 gallon per surface/acre.  A maximum of 10 gallons will be allowed.  The treatment is also being done in accordance with a current, valid Freshwater Wetlands permit, issued by the Department to the applicant, for water level control at the Horseshoe Lake dam during the herbicide application.  A Water Level Management Plan has been reviewed and approved.  The project site is Horseshoe Lake, south of Horseshoe Lake Rd., approximately 0.4 mi.east of the Rt. 19B intersection.

The applicant has applied for a renewal of the yearly, one-time treatment of .95 acre/feet of the Brockport Yacht Club boat basin with the aquatic herbicide Aquathol K.  The treatment is intended to control Eurasian water milfoil, an invasive, non-native plant species, using a surface application by power sprayer at an concentration not to exceed 3.0 ppm.  The maximum amount of herbicide allowed is 7.7 gallons.  The project site is the Brockport Yacht Club on Sandy Creek, approximately 700 ft. south of the Lake Ontario shoreline.

The applicant proposes to demolish a 500 sq ft cottage and replace with 1300 sq ft single family house, upgrade the on-site sanitary system, repair the existing breakwall and install the previously approved dock w/ hoist at his property located at 1262 Bayshore Blvd., in the town of Irondequoit, Monroe County.  The property is located on Irondequoit Bay, within the adjacent area of state regulated freshwater wetland, RE-1.

The Town of Penfield proposes to construct Extension 40 to the Penfield Consolidated Sanitary Sewer District, which consists of approximately 20,200 lineal feet (LF) of 8-inch and 10-inch gravity sanitary sewer mains, laterals and appurtenant structures, two duplex sewage lift stations and forcemain to serve approximately 165 residences in several areas of Penfield, including Atlantic Avenue, Baird Road, Five Mile Line Road, Shoecraft Road, Plank Road and State Road. The project includes three underground utility crossings of Hipp Brook and Tufa Glen Creek, and approximately 800 LF of sewer main within the 100-foot buffer area of NYS regulated wetland PN-2. The file is available for review at NYSDEC Region 8 in Avon.

The Department is prepared to issue a Water Quality Certification for the County Road 33 over Tri. 13 of  Mill Creek ( ONT 117-27-47-13) road culvert replacement  and the installation of 180 lineal feet of retaining wall to stabilize the roadway.

The applicant proposes the construction of a 3,800 square foot Wendy's Restaurant, including associated parking areas, drive through, utilities and landscaping. As a result 0.13 acres of federally regulated wetland will be permanently impacted.

The applicant proposes to place approximately 125 cubic yards of rock rip rap along approximately 250 lineal feet of Catharine Creek, Class C(TS) in order to protect the eroding stream bank.  The project also includes reshaping the large gravel bar and removal of woody debris that are blocking the stream channel. The project is located east of Route 14, approximately 1675 feet north of Hanrahan Road, on the east bank of Catharine Creek in the Town of Montour, Schuyler County

The applicant proposes to replace the County Route 62 bridge (BIN 3333790) over Rock Creek, Class C(TS) with a new concrete bridge.  The new bridge will be constructed just northwest of the existing bridge. The creek will remain in the existing channel until the new bridge is completed so that the construction will not be in contact with the water.

The applicant proposes to replace the existing multi-span County Route11 bridge (BIN 3333010) over Stocking Creek, Class C(TS), with a new single span concrete bridge.  The project includes a temporary detour through freshwater wetland BA-11 (Class II) just south of the existing bridge. Temporary cofferdams will be installed prior to construction. The impacts of construction will be temporary and minimized by the installation of silt fences for the control of erosion, sedimentation, and turbidity impacts to the project area.
