ENB Region 9 Completed Applications 04/19/2006

The applicant has purchased the site of this 81.3 acre sand and gravel mine from the former owner/operator, and requests reissuance of the permit which expired on May 26, 2003, in order to resume mining operations in accordance with the previously approved plans.  The approved plans included material processing by a portable dry-screen, portable crusher and portable wash plant, each with a maximum capacity less than 150 tons per hour, and reclamation to a condition suitable for agriculture.  Realignment of Tributary 2 of Sucker Pond was also authorized.  

The Department has made a tentative determination to approve a five year permit for discharge of up to 1,650 gallons per day of sanitary waste to an unnamed tributary of Lake Erie at an existing outfall from a 5 unit apartment complex septic system.  The permit will require effluent limitations and monitoring requirements for the discharge to take place twice per year.  The draft State Pollutant Discharge Elimination System Permit, referenced as SPDES # NY-0168357 is on file at the Region 9, Buffalo office.

Applicant proposes construction of a 10 lot patio home project at the end of Primrose Lane in the Larkspur Subdivision near the intersection of Maple Road and Wehrle Road in the Town of Lancaster. An access road to a stormwater detention pond and portions of lawns of the two end lots are proposed in the Adjacent Area of NYS Freshwater Wetland LA-4.
