ENB Region 1 Completed Applications 04/05/2006

The applicant proposes to install a treatment basin along Shore Road to increase stormwater capacity and treat discharge prior to overflow to Lake Ronkonkoma. Approximately 5000 cubic yards of material will be excavated to create the basin which is 80' wide x 160' long and 17' deep at its lowest point.  The project is located on Lake Shore Road, Ronkonkoma, Town of Brookhaven, Suffolk County, SCTM # 0200-724-01-028.001.

The applicant proposes to construct a 20 ft. x 40 ft. swimming pool with surrounding deck leading to a patio approximately 52 feet from the tidal wetland boundary.  The proposals do not meet the required 75 ft. setback from the wetland boundary and exceeds the 20% maximum lot coverage by impervious structures.  The applicant has requested a variance from the setback and lot coverage restrictions.  The property is located at 8 Belle Harbour Court, Center Moriches, Town of Brookhaven, County of Suffolk on Orchard Neck Creek.

The Department has made a tentative determination to modify an existing State Pollutant Discharge Elimination System (SPDES) permit for the facility known as the Atlantis Marine World and Riverhead Foundation for Marine Research SPDES #NY0226459. The exiting permit covers one outfall discharging to the Peconic River a Class SC surface water.  The modification includes an increase in the permitted flow to the existing outfall to account for new exhibits, increases in backwash flow and exhibit water changes.  The facility is located at 469 East Main Street, Riverhead, Suffolk County.

The Department has made a tentative determination to approve this application for a Solid Waste Management Facility permit pursuant to Title 6 of the NYCRR, Part 360 Solid Waste Management Regulations.  The facility proposes to accept and process up 299 cubic yards per day of construction and demolition debris for ultimate disposal in permitted facilities.  The proposed permit is essentially the same as the permit issued to the facility April 20, 1999 that expired April 19, 2005.  The facility has had NYSDEC permits, under previous owners dating back to the 1980s.  The facility is located on the southwest corner of Old Country Road and Midhampton Ave. in the Village of Quogue, the Town of Southampton, SCTM # 902-2-1-7.001, p/o 50.

The applicant is proposing to replace 212 linear feet of existing bulkhead up to 10' seaward of the present location.  This action will result in the filling of approximately 2,150 square feet of tidal wetland habitat.  The property is located on Shinnecock Bay at 369 Dune Rd. (SCTM # 900-364-1-16.1), Hampton Bays, in the Town of Southampton, Suffolk County, NY.

The applicant proposes to remove and replace 91 linear feet of existing concrete retaining wall with stone rip-rap, consisting of 60-80 lb. fieldstone interspersed with individual 500 lb. fieldstone.  Replace disturbed herbaceous emergent freshwater wetland vegetation adjacent to work site.  The property is located at Big Fresh Pond FWW #SH-3, on Big Fresh Pond Rd., Southampton, Town of Southampton, Suffolk County.

Applicant proposes to construct 105 linear feet of new low profile bulkhead, revegetate existing intertidal marsh area, and install a ramp and float. Project is located on Glenn Road, Southold.

The US Army Corps of Engineers seeks a modification to the Water Quality Certification for the Fire Island to Montauk Point Breach Contingency Plan to extend the area covered by the Breach Contingency Plan to include the barrier islands east of Fire Island (east of Moriches Inlet) to the area of the Southampton mainland just west of Halsey Neck Lane. This extended area would include the 15-mile long barrier island containing Westhampton and Tiana beaches and the 4-mile segment which extends east of Shinnecock Inlet to the Southampton mainland.  These additional areas were previously examined and considered under the Breach Contingency Plan study and received a full review under the National Environmental Policy Act (NEPA) but were not included in the Water Quality Certification which was ultimately issued.  No changes to the components of the Breach Contingency Plan would occur.  The Breach Contingency Plan would continue to authorize the filling and closing of breaches in the barrier islands, caused by coastal storms, utilizing a design template of a 150-foot wide sand berm and 9-foot high dune constructed between the Atlantic Ocean and the back bay blending into existing topography.  Potential sand sources would continue to be from a variety of authorized sources including upland sources, strategic stockpiles, existing channel and harbor dredging operations or offshore borrow areas.
