The applicant proposes to
modify an existing SPDES Permit by adding another outfall
which will discharge to an unnamed tributary of Coeymans Creek, a Class C waterbody.
The discharge of an average of 0.8 mgd (maximum of 2.9 mgd) of quarry pumpout water
will result from activities carried out in the quarry, including drilling, blasting, hauling
and crushing of limestone necessary for the clinker-making process.
Other modifications to the
permit will include: 1) Two outfalls will now discharge to an
unnamed tributary of Coeymans Creek instead of to Coeymans Creek; 2) An outfall to
handle the settling pond overflow will be added; 3) The sample type for two of the
existing outfalls will change from composite to grab to provide a more representative
sampling at the time of discharge; 4) Best Management Practices requirements will be
added; and 5) The requirement to submit a plan to reduce total suspended solids will be
removed as this issue has been addressed and a modified schedule of compliance to
require implementation of the approved Coeymans Creek Improvement Plan by January
30, 2007, will be included.
The Department has made
a tentative determination to issue a permit for a State Pollutant
Discharge Elimination System permit under Article 17 of the Environmental
Conservation Law. This tentative determination indicates that the discharge regulated
under this statute is considered to satisfy regulatory standards for permit issuance, based
on information available to the Department at this time. As a tentative determination, the
Department seeks comments on the proposed regulated activity prior to making a final
decision on permit issuance. As such, this tentative determination does not signify
Department approval for or endorsement of the activity for which a permit is sought or
for the overall proposed project.

for inspection and comment at the Region 4 Office.
