to construct a boat ramp on Tonawanda Creek in Kibbe
Park. The work will consist of a stone ramp excavated into the bank approximately 16
feet wide. The ramp will have a grade of no more than 12% slope and will have a depth
of approximately 3 feet. The work will include no more than 80 linear feet of disturbance
along the creek. A cofferdam, turbidity curtain, and silt fence will be used during
construction.

Rochester Gas and Electric
proposes to add a second 5,000 gallon horizontal above
ground tank system, with secondary containment, to store used transformer oil drained
from their field equipment. They also propose to commence on-site re-refining of the oil,
including heating and filtering, in a processing trailer which will be added to the facility.
Impurities will be removed from the oil at a maximum rate of 35 gallons per minute so
that the re-refined oil can be shipped back for re-use in the applicant’s equipment. The
filtering media from the processing unit has been determined to be non-hazardous and
will be disposed of at an off-site solid waste management facility. The tanks and re-refining
trailer were determined to be exempt from air permitting requirements. The file
is available for review and comment at the NYSDEC Region 8 Office in Avon.

The Department has received an Air State
Facility application from Dolomite Products
Co Inc, d.b.a. Rochester Asphalt Materials, for existing operations at its Victor Hot Mix
Asphalt Plant, located at 7607 Commons Blvd in the Town of Victor, Ontario County.
As part of this application, Dolomite Products
Co. Inc. has proposed to restrict the Victor
Hot Mix Asphalt Plant potentials to emit carbon monoxide (CO) and oxides of nitrogen
(NOX) to below the 6 NYCRR Part 201-6 (Title V) and Part 212 Reasonably Available
Control Technology (RACT) applicability thresholds for a Major Stationary Source.
In response, the Department has drafted
a Special Permit Condition to limit asphalt
production in any 12-month period sufficiently to restrict CO emissions to less than 100
tons. This asphalt production limit will also reduce facility potential to emit NOX,
emitted
at a lower rate than CO, to below the Part 201-6 and Part 212 thresholds of 100 tons per
year.
To verify that the facility is in compliance,
Dolomite Products Co. Inc. will be required to
maintain a log of monthly asphalt production at the facility, 12-month rolling totals of
asphalt production, and calculate annual totals of emissions. These records are to be
maintained for a minimum of five years, and must be made available with all supporting
data to Department inspectors upon request.
Also as part of this application, Dolomite
Products Co. Inc. has proposed to use waste
oil, classified as "Waste Fuel A" in 6 NYCRR Part 225, as a fuel, in addition to natural
gas and #2 fuel oil. Waste Fuel A does not contain chemical waste and is subject to
contaminant limitations specified in Part 225-2.4(b). For all three fuels, the contaminant
emitted at the greatest rate remains CO.

portions of the landfill where elevations have reach final grade on the existing 23.2 acre
landfill to allow for reduction of the amount of horizontal geomembrane seams and allow
for additional settling time. The landfill will be covered by intermediate cover and shall
be seeded and mulched to ensure adequate growth of vegetation is established. The final

and thus requires a 401 Water Quality Certification. As required by the Buffalo District
U.S. Army Corps of Engineers mitigation will require the creation of a 3.01 acre wetland
area on the project site. The project will also be required to comply with the NYSDEC
SPDES General Permit for Stormwater Discharge from Construction Activity, Permit No.
GP-02-01 and the NYSDEC Petroleum Bulk Storage Regulations. Project site is located
