The applicant proposes to
construct an elevated walking trail, on piers, in New York
State regulated Class II Wetland BU-11, as part of the proposed Fox Run at Orchard Park
Lifecare Community for senior citizens. The walking trail will be constructed of stone
chips in the regulated one hundred foot wide adjacent area of the wetland. Areas of the
adjacent area that were previously cleared and farmed years ago will be used for storage
of soil materials and equipment during construction of the project and then those areas
will be graded and be replanted to native grasses and forbes.

An-Cor Industrial Plastics
is a reinforced composite production facility that manufactures
products by using thermoset resins containing Styrene. This Department has prepared a
Draft Permit and has made a tentative determination to approve this federally enforceable
Air State Facility permit which describes emission caps to limit annual potential emissons
of Styrene to less than 10 tons per year and annual potential total Hazardous Air
Pollutants to less than 25 tons per year to establish the facility as a minor source not
subject to the requirements of the National Emissions Standards for Hazardous Air
Pollutants: Reinforced Plastic Composites Production 40 CFR Part 63.5790 Subpart
WWWW. The facility also will be established as a minor facility under 6NYCRR Part
201 and 6NYCRR Part 212.10 (Reasonably Available Control Technology Requirements
for Volatile Organic Compounds). By accepting these caps the company will not require
a Title V permit.
