Department of Environmental Conservation

Pursuant to 6 NYCCR Part 375 of the Environmental Conservation Law or notice requirements of §202 (1) of the State Administrative Procedure Act, or both such statutes, the Department of Environmental Conservation hereby gives notice of the following:

Release of the Draft Remedial Action Plan (RAP) for the former Halesite MGP Site -Town of Huntington, Long Island, New York. The RAP describes the remedy proposed to address site contamination related to the operation of the former MGP site. The New York State Department of Environmental Conservation (NYSDEC) and New York State Department of Health (NYSDOH) have found the RAP to be approvable and protective of human health and the environment. The draft RAP is available for public review and comment. This notice begins the formal public 30-day comment period which runs through March xx, 2006.

Brief Project Description: The former Halesite Manufactured Gas Plant (MGP) Site is located in the Halesite area of the Town of Huntington, Suffolk County, New York. The site is owned by the Long Island Power Authority (LIPA). A portion of the site is used by LIPA as an electric system substation, which is currently operated and maintained by KeySpan for LIPA. The remainder of the site is a steeply sloped, heavily vegetated and vacant. Contamination is generally limited to the site itself; however, tar-saturated soil was observed in two small areas immediately west and south of the site. The site investigation, which included a well and basement survey, indicates that groundwater is not a potential source of off-site exposure.

Positive Declaration

Suffolk County - The Town of Southampton, as lead agency, has determined that the proposed expansion of g a pre-existing sanitation and cesspool business may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. The action involves ormalizing and expanding a pre-existing sanitation and cesspool business that includes residential trash, garbage and recyclables pick-up, cesspool service, processing of construction and demolition material, concrete and land clearing debris and disposal of same and the leasing of port-o-lavs and dumpsters; the construction of a 12,500 sq. ft. demolition and construction processing facility, and a lot line modification to separate the pre-existing residential uses from the commercial operations. A 2.7 acre parcel located at 42 Sandy Hollow Road, located approximately 1,250 ft. north of County Road 39; a 1.2 acre parcel located at 55 Henry Road; a 1.0 acre parcel located at 49 Henry Road; and a 1.0 acre pacel located at 43 Henry Road. All parcels are located in the R-20 zoning district and identified as Suffolk County Tax Map Parcels 900-131-1-8.1 and 8.2, 10, 11 & 12, Town of Southampton, County of Suffolk, NY.

Notice Of Acceptance Of Draft EIS And Public Hearing

Suffolk County - The Town of Southampton, as lead agency, has accepted a Draft Environmental Impact Statement on a proposed local law to enact a new §330-248 O. Oof the Town Code of the Town of Southampton (herein after referred as “HBWCIPDD” legislation). A public hearing on the Draft EIS will be held on March 10, 2006 at 1:00 p.m. at the Southampton Town Hall, 116 Hampton Road, Southampton, NY. Written comments on the Draft EIS will be accepted until 05/23/06. The action involves a proposed local law to enact a new §330-248 O. Oof the Town Code of the Town of Southampton (herein after referred as “HBWCIPDD” legislation) to facilitate the construction of a 50,000 sq. ft. supermarket with 276 paved parking spaces (in addition to 47 existing spaces for mcDonald’s), a 20,872 sq. ft. passive park, and an existing 3,142 sq. ft. fast food restaurant (McDonald’s) with drive thru constructed on the southwest portion of the site with associated improvements. The parcels are located on the north side of Montauk Highway (CR 80) approximately 500 ft. west of Flanders Road (also known as Riverhead-Hampton Bays Road (SR 24) in Hampton Bays and are identified as SCTM #900-221-3-16.1 and 900-221-3-18, Town of Southampton, County of Suffolk, New York.
