Draft Amendment No. 3 to the FFY 2006 DWSRF Intended Use Plan

The Federal Fiscal Year (FFY) 2006 Intended Use Plan (IUP) for the Drinking Water State Revolving Fund (DWSRF), dated September 27, 2005, is being amended.

Amendment No. 3 to the FFY 2006 IUP authorizes waivers, on a provisional and emergency basis, to the DWSRF financing policies to address the needs of the 2006A Winter Pool applicants and certain others caused by the delay in financing for the 2006A Winter Pool.

Copies of the draft amendment will be mailed to those applicants with projects targeted for financing in the Winter Pool. The Draft Amendment No. 3 will be available on the EFC web site at http://www.nysefc.org (click on “What’s New” or “Drinking Water”). Copies of Draft Amendment No. 3 can also be requested by calling the EFC toll-free line at (800) 882-9721 (within NYS only) or at (518) 402-7433.

Draft Amendment No. 1 to the FFY 2006 CWSRF Intended Use Plan

The Federal Fiscal Year (FFY) 2006 Intended Use Plan (IUP) for the Clean Water State Revolving Fund (CWSRF) for Water Pollution Control Projects, dated September 2005, is being amended.

Amendment No. 1 to the FFY 2006 IUP reflects the temporary waiver of the CWSRF financing policies to address the needs of applicants impacted as a result of EFC’s suspension of its leveraged financing program. This action was necessary due to the USEPA’s internal discussions regarding interpretation of the Clean Water Act with respect to the provision of 30 year financing to CWSRF applicants.

Copies of the draft amendment will be mailed to those applicants with projects on the IUP Annual Lists and to other interested parties. The Draft Amendment No. 1 will be available on the EFC web site at http://www.nysefc.org (click on “What’s New” or “Clean Water”). Program Policy Issuance

The New York State Department of Environmental Conservation has prepared the Program Policy entitled, "Public Hearing Processes for Oil and Gas Well Spacing and Compulsory Integration." The Policy takes effect 30 days from the date of this notice. The Policy provides guidance to Department staff for the initiation and conduct of public hearings for oil and gas well spacing and compulsory integration. This Policy was developed to provide procedures for the hearings that are required by statutory amendments enacted on August 2, 2005.

Comments on the draft Program Policy dated October 26, 2005 were accepted through November 25, 2005. Based on these comments, language in the policy was clarified but no changes were made to the public hearing processes as described in the draft policy. The Policy can be obtained from Kathy Sanford, NYSDEC Division of Mineral Resources, 3rd Floor, 625 Broadway, Albany, New York, 12233-6500.
