The applicant proposes an
existing discharge of up to 17,200 gallons per day of treated
sanitary wastewater with ultraviolet light seasonal disinfection to tributary #3 of North
Meadow Brook, a Class C(T) waterbody from a secondary treatment plant at the
applicant's facility located off NYS Route 73. The applicant plans to operate an open,
recirculating sand filter treatment system. This brand new system replaces an existing
buried sand filter treatment system.
The Department has made
a tentative determination to issue a permit for a State Pollutant
Discharge Elimination System permit under Article 17 of the Environmental
Conservation Law. This tentative determination indicates that the discharge regulated
under this statute is considered to satisfy regulatory standards for permit issuance, based
on information available to the Department at this time. As a tentative determination, the
Department seeks comments on the proposed regulated activity prior to making a final
decision on permit issuance. As such, this tentative determination does not signify
Department approval for or endorsement of the activity for which a permit is sought or
for the overall proposed project.

The applicant requests Water
Quality Certification for the continued operation and
maintenance of the existing Macomb Hydroelectric Project located on the Salmon River
in the Town of Malone, approximately 2.5 river miles north of the Village of Malone, in
Franklin County. The project has a generating capacity of 1,000 kW. The Water Quality
Certification is part of an application to the Federal Energy Regulatory Commission
(FERC) for a new license; Project No. 7321-NY. The project would be run in accordance
with applicable provisions of the Macomb Project Settlement Agreement dated
November 2, 2004. That settlement includes the following: maintenance of a base flow
of 125 cfs (or inflow to the Macomb impoundment, whichever is less) from the Project's
tailrace, fish protection provisions and downstream fish movement provisions, sediment
management, and a requirement to install a fish stocking tube in the Project's tailrace. A
draft Water Quality Certificate is available for public review at the Region 5
Headquarters.

existing discharge of up to 140,000 gallons per day of treated
sanitary wastewater to Cedar River, a Class B(T) waterbody from a secondary treatment
plant at the applicant's facility located at NYS Routes 28 & 30, Indian Lake. The
applicant constructed a new wastewater treatment plant with an increased design flow
utilizing the existing outfall pipe. The new plant replaced the existing plant built in 1971
which had a design flow of up to 100,000 gpd.
The Department has made
a tentative determination to issue a permit for a State Pollutant
Discharge Elimination System permit under Article 17 of the Environmental
Conservation Law. This tentative determination indicates that the standards for permit
issuance, based on information available to the Department at this time. As a tentative
determination, the Department seeks comments on the proposed regulated activity prior
