The Department has made
a tentative determination to issue a permit for a State Pollutant
Discharge Elimination System permit under Article 17 of the Environmental
Conservation Law. The applicant proposes to discharge backwash from an iron removal
filtration system to groundwater. The applicant proposes to install an Ion Exchange
Drinking Water Treatment System and Spent Brine/Rinse Water Injection well. The
injection well will dispose of the Spent Brine/Rinse Water. The system is associated with
a public supply well located at Brown's Hill Road well field and pump station, Browns
Hill Road, Orient, Town of Southold.
This tentative determination
indicates that the discharge regulated under this statute is
considered to satisfy regulatory standards for permit issuance based on information
available to the Department at this time. As a tentative determination, The Department
seeks comments on the proposed regulated activity prior to making a final determination.
As such, this tentative determination does not signify department approval for or
endorsement of the activity for which a permit is sought or for the overall proposed

The Department has prepared
a Draft Permit and has made a tentative determination to
approve this application for modification of an Air State Facility permit pursuant to
Article 19 (Air Pollution Control) of the Environmental Conservation Law (ECL). This
modification includes corrections to boiler ratings, replacement of of the sterilizer, and
institutes caps of annual capacity factors for two of the West Campus Power Plant
boilers. The facility has agreed to conditions that will limit the emissions of oxides of
nitrogen and will therefore not be subject to the NOx RACT requirements under Title V.
These permit condition limitations will also limit the operation of two newly installed
burners keeping the facility below the thresholds of New Source Review requirements.

The Department has prepared
a Draft Permit and has made a tentative determination to
approve this application for an Air State Facility permit pursuant to Article 19 (Air
Pollution Control) of the Environmental Conservation Law (ECL). The primary emission
units at the facility consist of three (3) 18 MMBTU/hr E. Keeler Co. boilers with Todd
burners, burning natural gas and No. 2 fuel oil and six (6) emergency generators. The
facility's potential to emit (PTE) oxides of nitrogen (NOx RACT) exceeds the major
facility threshold of 25 tons per year (tpy). The proposed State Facility Permit caps NOx
emissions at the facility to less than 22.5 tpy by providing a method to demonstrate that
fuel usage, on a monthly rolling basis, is limited such that the NOx regulatory threshold
will not be exceeded. The facility has agreed to accept permit conditions that will limit
facility wide emissions of oxides of nitrogen at 22.5 tons per year. By accepting these
state and federally enforceable limits the facility will not be subject to the provisions of
the Title V operating permit program and New Source Review requirements. The
application and the draft permit are available for review at the Region 1 office in Stony
Brook. The facility is located at One Healthy Way in the hamlet of West Islip, Town of
Islip, Suffolk County.
