made a tentative determination to approve this application for a new
permit for a proposed discharge of 100,000 gallons per day of treated sanitary wastewater
into Fishkill Creek from a tertiary treatment plant at a proposed 199-lot subdivision of
370 +/- acres called "The Springs at Beekman". Also applied for are permits for a Public
Water Supply, Freshwater Wetlands (to connect to wells within the 100 foot adjacent area
of wetland # PQ-8), and Stream Disturbance for the treatment plant outfall. Draft SPDES
and Water Supply permits are available for review. A detailed Stormwater Pollution
Prevention Plan has been prepared. The location is north and south of Beekman Road at
the intersection with Green Haven Road.

The
Westchester County Department of Department of Environmental Facilities has
applied for a modification of the current Part 360 permit for its Sprout Brook Ash Residue
Disposal Facility (the Ashfill).
Background: The ashfill facility is the sole disposal facility for the ash generated by
the County's nearby Charles Point Resource Recovery facility which serves the waste
disposal needs of a large portion of Westchester County. The 38-acre County facility was
first permitted in 1983 and has been receiving ash since shortly thereafter. The Ashfill
currently meets all of the safeguards in the Part 360 regulations governing the design,
construction and operation of this disposal facility, including a baseliner system under the
ashfill, a leachate collection system to collect leachate generated by the ashfill, a
groundwater well monitoring system around its perimeter and a final cover system to keep
out rainwater, which is the source of any leachate.
Requested
Modification: The applicant requests a modification the Ashfill Part 360
permit to extend the existing baseliner system approximately 50 feet beyond the current
limit along Phases 1 and 2, and to revise the operational filling sequence until the end of
the facility's operational life, which is expected to be through 2009. This will provide the
County with approximately 522,000cubic yards of ashfill capacity. This modification will
raise the side slopes of the ashfill but will not increase its maximum height.
Variance: The applicant is also seeking a variance to allow the final cover of the
ashfill to be made up of a combination geocomposite material covered by gravel
throughout the landfill, instead of the geocomposite material covered by topsoil, which is
normally required by the regulations. Because the cover material is meant to hold the
geocomposite material in place, the County believes substituting gravel for soil on top of
the geocomposite material will satisfy this requirement of Part 360.

The applicant proposes
to modify a portion of the 100 foot adjacent area of Freshwater
Wetland D-16 (Class I) in order to construct various improvements to an existing single
family residence on a 3.89-acre parcel. Activities proposed within the adjacent area
include construction of an addition to the home, a new swimming pool, new paved
parking area and garage, new walkways and terraces, and a new potable water well. No
disturbance is proposed within the wetland; the total area of disturbance to the adjacent
area is 0.11 acre. Although no disturbance is proposed within Freshwater Wetland D-16,
approximately 0.24-acre of adjacent area of the wetland will be replanted with native
vegetation at the project site as mitigation. The project is located on the south side of
Upper Shad Road, 500 feet east of High Ridge Road (NYS Route 137) in the Town of
Pound Ridge, Westchester County.
