The applicant proposes an existing discharge of stormwater from oil and ammonia containment areas to groundwater and surface water from an oil/water separator and treatment system at the applicant’s facility located at 289 Buffalo Ave., Freeport, Nassau County.

The Department has made a tentative determination to issue a permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation Law.  This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time.  As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.  As such, this tentative determination does not signify department approval for, or endorsement of, the activity for which a permit is sought or for the overall proposed project.

Refer to this application by application number listed above and SPDES number, NY0226416 .  The proposed discharge is located within an area designated as a sole source aquifer.  The following water purveyors have been identified as having service areas located within a 3-mile radius of the applicant's facility: Freeport Village Water, Rockville Centre Water, Long Island Water Corporation, New York Water Service Corporation.

Applicant proposes to cut and remove decaying vegetation.  Construct a 4' wide crushed stone path throughout the fresh water wwetland and adjacent area.  Stepping stones are proposed to cross the stream i and the rechage basin will be regraded and planted according to a restoration plan.  Approx. 75 cu yds of material will be rexcavated and emoved off site.  An asphalt play court (55' x 44') will be constructed southeast of the recharge basin and uffer area.  The property is located  at 1 Pond Lane, Sands Point, Town of North Hempstead.

The applicant proposes to construct one new jockey well for irrigation.   The well will be a 6" diameter, 40 gpm, and 420' deep. The well is associated with an existing 750gpm well already located at the site.         

The applicant proposes the construction of one new 20" X 10" diameter well rated at 1,300 GPM and approximately 590 feet deep.   The well will be located in the existing Chestnut Street Well Field, Port Jefferson Station, NY.

The applicant proposes construction of one new 10"X 6" diameter water supply well( well #4) which will pump up to 50 gpm and be approximately 70 feet deep.   The well will be located in the existing Middle Road Well Field, Peconic, NY.  Town of Southold.

The applicant proposes to replace 70 feet of existing bulkhead in place and 18 inches higher in elevation, construct a wood walkway, one 6 foot return and 10 feet of new bulkhead to close off an existing boat slip, fill 160 square feet of Tidal Wetlands known as litoral zone and dredge 10 feet seaward of the bulkhead.  The project site is located at 96 West Lido Promenade, Lindenhurst, Town of Babylon, Suffolk County.

Applicant proposes to to construct a sanitary sewage pump station, gravity sewer collection system with a total of approx. 4,000 linear feet of 6'" diameter force main.  The project requires dewatering of 500 linear foot trench to install 500 linear feet of 6" diameter force main in the vacinity of the proposed sewage pump station.  The project will require dewater in excess of 1 million gallons per day and is located in the adjacent area of freshwater wetland BW-1.  Project location is Wyandanch Avenue, 350  feet north of Governor Avenue, West Babylon.

The  Department has prepared a Draft Permit and has made a tentative determination to approve this application for an Air State Facility permit pursuant to Article 19 (Air Pollution Control) of the Environmental Conservation Law (ECL).  The facility operates a hot mix asphalt plant.  The facility's potential to emit (PTE) Oxides of Nitrogen (NOx) and Sulphur Dioxide (SO2) exceeds the major facility threshold of 25 tons per year (tpy). The proposed State Facility Permit caps NOx emissions at the facility to 11 tpy and SO2 to 13 tpy.  The facility has agreed to accept permit conditions that will limit the production of asphalt to no more than 400,000 tons per year.  By accepting these state and federally enforceable limits the facility will not be subject to the provisions of the Title V operating permit program.  The application and the draft permit are available for review at the Region 1 office in Stony Brook.  The facility is located at 56 Comsewogue Rd., hamlet of East Setauket, Town of Brookhaven, Suffolk County Tax Map         # 0200-134-4-P/O 6.12.

The applicant proposes to construct a two-story single family dwelling with a deck and porch on a vacant wooded lot.  A septic system and gravel driveway are also proposed to be constructed.  The proposed project is located within 23 feet of a NYSDEC regulated freshwater wetland at 286 Madison Street in the Village of Sag Harbor in the Town of Southampton in Suffolk County, SCTM# 0903-06-03-42.2.
